I attended a webinar yesterday on the new Firearm Excise Tax, which takes effect on July 1st. While I anticipated some ambiguity, the session left me with more questions than answers. It appears that the state may be targeting small Federal Firearms License (FFL) holders, potentially driving them out of business. I am curious if others share this concern and if there are any legal actions we can pursue.
As a small, home-based FFL, I retired from the local Sheriff's Office in 2019. My FFL business allows me to stay connected with former colleagues, but I am required to maintain the same licensing standards as larger gun stores. Although I am licensed to sell firearms, my role is primarily to facilitate online orders for my customers, who are mainly current or retired law enforcement officers. These clients are exempt from the new tax. Since I do not sell firearms directly, will I be required to count all the guns I receive on behalf of my customers as my sales? I have sent a list of questions to the CDTFA so we shall see what they come back with; however it frustrates me that the state is trying to put all the small dealers out of business! Anyone else share in my frustration?
