    Buying a handgun from a dead man.

    My neighbor asked me this yesterday so i told him I'd ask the experts.

    A friend of his died and had a few guns. There was no will and no kids. Only his surviving wife. My neighber wanted to buy a couple of his handguns. How can he do that with the registered owner not available to do a PPT?

    Any help would be appreciated. He wants to do this all above board. Second question is: in the event that his friend bought a handgun when he lived out of state and failed to register it in CA, what would be the proper protocol? Bot handguns are revolvers and not C&R. He asked me the second question as a "what if" scenario.

    The wife presumably owns them by operation of probate law.

    As owner, she can sell them PPT.

      Thank you for the reply. So essentially he needs to take the widow to the FFL and do the PPT. Would she need to take anything to prove his death and their marriage?

                No, from what I understand you are able to private party transfer (PPT) multiple handguns a month. You are only restricted to one handgun a month for new purchases.

                  So for convenience, could he do a separate DROS for each handgun at the same time? So the widow only has to go to the FFL once?

                    That is correct, one DROS is required per firearm, but you can transfer multiple firearms per visit.

                      Yes...and in fact the buyer will save a whole $4 per DROS on every handgun after the first (additional handguns in a single transaction are reduced to $21 per handgun). California is all about saving the customer money.

                          PPTs are exempt. What is restricted are dealer sales, which can be new or used. Consignment sales can be done as a dealer sale or a PPT.

                          If the firearms are on the certified list, the firearms can be shipped/dropped off, but then the fees would not be limited and the one gun per 30 days would apply.

                              Curious indeed. If FFL transfers can only be done at the place of business or a gun show, is there any consideration for this? Or is it already assumed that gun shops must be wheelchair accessible?
