What is the process and what hoops are there to jump through for an 03FFL to get his 07FFL?

Thanks for the link, but what i need to know (without an in depth study) is what extra stuff does an 03 FFL have to do to also be an 07?

The bottom line is you need to look at what the requirements are to get an 07 FFL. There is no connection between 01, 02, 03 or 07 FFLs.

For all practical purposes you are starting from scratch. An 03 FFL doesn't count for anything as far as making it easier.

As a first step you might want to check the zoning of the location you intend to use for your 07 licensed premises.

Thanks guys. I am curious because my buddy is an FFL 03 and a great gunsmith, etc. his shop is set up nicely and he has the skill set to manufacture stuff if he wanted to. And I was curious to know if it was a big deal to add 07 to his o3. But I guess the 07 isnt an add on like I thought. This helps answer my question.

He wont have any issues at his current location as far as zoning fortunately. This county is pretty easy generally speaking.

So now the question is if there are requirements or hoops to jump through for an 07 that are more severe or different then what he had to do for his 03....like mandated insurance requirements,facility requirements, etc.

Yes, there are more hoops. Because it is a license to operate a firearms business, getting an 07 FFL will be very similar to getting an 01 FFL. He will need to show compliance with all State and local zoning and business rules. He will need to get permission of the property owner if he doesn't own the property...etc.

Generally if he is taking possession of firearms to do gunsmithing, he is supposed to have an 01 FFL. They used to have an FFL specifically for gunsmiths, but they combined them with the 01 FFL. It would be easier to get an 01 for just walk in gunsmithing, as you wouldn't need the local business permit for "retail sales of firearms", but you also wouldn't be able to accept interstate shipped firearms either because you would not be on the centralized list.

Wait a second...ok, im stupid. I apologize. I dont know why I kept posting 03 (probably because its what I have)...he is an 01 FFL. He has an 01 FFL to sell retail to the public from his shop. It is a business with all of the necessary zoning, licensing, boad of equalization, DOJ stuff, etc. He even owns the property.

So, the new question is are there additional hoops that are different for an 07 then a 01?

Is it still starting from scratch?

07 is $50 cheaper for the application fee, but the application process is identical.

Your local planning department will be the entity that decides if you can get an 01 or 07. Cali DOJ requires the language "valid for retail sale of firearms" on your business license. BATFE does not care about this and will happily issue a license, but without DOJ approval, you won't be a functional dealer in California.

As an 07 you will be subject to ITAR registration if you manufacture ammo or firearms ($2500/year). BATFE interpretation of "manufacture" is very broad.

From what I have heard, many do not register for ITAR since they believe it has to do with exportation of manufactured items only. Sadly, the U.S. State department says that registration is mandatory even if you don't intend to export. They only appear to enforce it for those that export, today. It is unclear whether anyone has ever been fined for failure to register if they are not exporting. That being said, the fines are very hefty (millions).

The reson I ask is the shop I worked at had an 01, then we started doing a lot of ar business the license was up for renewal and he just had it switched to an 07 with no work whatsoever. So it might be worth waiting, or just fire it off and be done with it.

That wasn't our experience at all. We had to submit all the paperwork and go through an ATF interview and all the other work involved with getting the 01. It is by no means just a simple request you make to the ATF. Granted, already having all the business requirements set up in advance to get the 01 did make it easier and we did not have to resubmit fingerprint cards. Still, it is going to take about 3 months or so to get it.
