I would assume they had no idea. They may have purchased it used, and it didn't get caught at that time, or the owner simply had not reported it missing at that point. Depending on how long ago it was stolen, there might be no way to track down who was responsible.

It has been my experience with stuff like this, you never get your money back. If they are a repeat customer, and had no idea it was stolen, you may want to eat the cost anyway. You have to look at how much business they have done thus far and will continue to do with you in the future, and act accordingly from there. So if you think they were clueless about it, you may want to protect the many future transactions they will be bringing you. Just food for thought.

If you think they stole it, that is a completely different story. Not that you will ever really know for sure.

Very difficult spot you find yourself in.

Yeah, I was told I could take them to small claims, not worth my time for the $130.00.

Yes, he was very cooperative and said that it was impossible that it was stolen, he owned since it was new and still has the receipt from the Stockade.

hmm, if he bought it new from Stockade and has the receipt, it sounds like it might be a case of mistaken identity on that gun being stolen. Such as a typo when it was entered into the system. I bet it could be traced back to your seller to prove it wasnt' stolen, but on a $130, probably not worth it.

No, DOJ wouldn't tell me why the DROS was delayed, they eluded to the gun being under investigation. The PD that picked up the gun called me to tell me it was stolen.

That is entirely possible.... or duplicate serial numbers.

Didn't someone recently post that when a cop ran the serial on their rifle, it came back as a stolen .357 or something like that, and it was such an obvious case of two manufacturers having overlapping serial numbers that the cop told the guy about the "stolen" report and let him go.

If the guy has the receipt from the Stockade, I'd present that when the gun is turned in.

Has the guy ever posted photos of it online? This could be a case of someone snagging a serial number from a photo.

Thats exactly why I keep all my paperwork/receipts and have a copy of the DROS (I just asked for a copy and they gave me one)... Just in case either:
                          • I need to quickly report it stolen
                          • For some reason my gun is reported stolen and it was a mistake

Then again, maybe im a little paranoid.

The investigating PD said the stolen gun report was the exact description of the gun and serial number.

I vote eat it. Or at least ask the police how you can verify it is stolen and that someone isn't just stealing your gun. That is a good question. How do you know it was really stolen? Shouldn't you have access to the police report?

Losing $130 is nothing. I lost $250 when I broke a Colt upper and $1000 when I shipped a ACOG to Florida on a Las Vegas billing address. Crap happens. Learn from each other's mistakes.

I don't think there is a way to avoid buying stolen guns unless you take them on consignment and don't pay for 30 days. Maybe your doing a personal PPT came back to bite you!
www.tenpercentfirearms.com was open from 2005 until 2018. I now own Westside Arms.
