21626.
(a) A “secondhand dealer,” as used in this article, means and includes any person, copartnership, firm, or corporation whose business includes buying, selling, trading, taking in pawn, accepting for sale on consignment, accepting for auctioning, or auctioning secondhand tangible personal property. A “secondhand dealer” does not include a “coin dealer” or participants at gun shows or events, as defined in Section 478.100 of Title 27 of the Code of Federal Regulations, or its successor, who are not required to be licensed pursuant to Sections 26700 to 26915, inclusive, of the Penal Code, who are acting in compliance with the requirements of Sections 26500 to 26585, inclusive, and 27545 of the Penal Code, and who are not a “Gun Show Trader,” as described in Sections 16620 and 26525 of the Penal Code.Comment

I have had extensive conversations with DOJ about this. You do not need a 2nd hand license to buy and sell used firearms. You just enter them as acquisitions through the DROS Entry system and wait 30 days to sell.
You must have a 2nd hand license to consign firearms. These still must be entered as acquisitions through the DROS entry system, but once you have your 2nd hand license (and you tell your field rep you have one), they will modify the acquisition menu which allows you to select "consignment" when entering the firearms. This is an important distinction as you can't buy a used off roster handgun and resell it (in CA), but you can "consign" an off roster handgun and resell locally as a PPT. Pawn shops may be slightly different as I think they have a different system for logging acquisitions.
Aces raises an interesting question about how transactions are counted when a consigned firearm is sold as a PPT. Its my understanding that it doesn't count as a single transaction, its remains part of the original multiple firearm - single transaction, but I've never asked that question of DOJ.Comment

I understand that is what many FFLs have been told, but does anybody actually have anything in the PC or Financial Code that specifically exempts FFLs? I've never found anything.Interstate Transfers $100 (DROS included with the price)
