    1st time buying used gun

    Happy New Year Calguner
    I left my old gun at a local gun store for consignment. it required that my gun have to be there for 30 days for back ground check before it can be transfer to the new owner. If I buy a used gun from 1 of the seller here on calguns, do I have to do the background check on the gun just like I sold my gun? thank you

        when i leave my gun at the shop for sale on consignment the store required to run a back ground check on the gun for 30 days before they transfer to the new owner

            There is a law (rule?) that a dealer must hold a consignment gun 30 days before it can be sold (to see if it's stolen). They can start the DROS on day 20 and deliver it on day 30. Any PPT or purchase of a new or used gun from a dealer has the normal 10 day wait. You can list and sell it yourself and not lose the usual 30% consignment fee or wait for your cash.

              I found a gun in the sale forum that I want to buy, should I have the gun Chex before I buy? I don't want to buy a stolen or a gun that has been in a crime.

                  This is legal but is it prudent? What happens if it comes back stolen after you've started the DROS for a buyer? Seems like you're out the DROS fee and have an unhappy customer. I suppose the odds of that are small but I hold them 30 days.

                    I recently requested from a LEO friend such a thing, he declined and said that now anytime they do a search they have to make a notation as to why and for what case, so its a no-go. Coincidentally I've heard that Mohave County Sheriff is happy to check for you serial numbers vs the national registry as FTF sales are legal in AZ and therefore its a prudent thing to do out there.

                        I had a few higher ups in the past that would for us occasionally when we would buy something, but we only did it once in a while and never over used it. And I hadn't attempted that in over 4 years or so until last month.

                          thanks everyone taking your time to answer my question. I don't think buying a used gun is a good idea. waiting 30 days is too long for the seller. I would ha e to kiss my xdm good bye. again thank you for all of your time and effort.

                            Wait a minute. The 30 day rule only applies to a consignment gun or a gun the FFL has bought to put into his inventory. The situation you describe is different.

                            If you are buying from a private party on Calguns, the 30 days doesn't apply.

                            If the gun is on-roster, the seller can ship it to your FFL who then does the transfer. Seller gets paid immediately by you. You have a 10-day wait after you start the DROS before you can pick up the gun. If its off-roster you'd have to do it face to face as a Private Party Transfer. Again, no 30 day wait and the seller gets paid immediately. You'd have to meet the seller at a FFL.

                            The PPT is the cheaper way to go. PPTs are $47.19 by law. If you do it by mail, you have to pay shipping and your FFL can charge whatever they want.

                            There is always a risk that a privately sold firearm is stolen. That will typically show up during the DROS. But the risk is pretty low if the seller is willing to deliver the gain to a FFL for transfer.

                              Let me try and say what everyone here has been saying, clearly and with added emphasis:


                              THERE IS NO 30 DAY WAIT WHEN YOU BUY A USED GUN FROM A PRIVATE PARTY!

                              THE FACT THAT YOU YOURSELF CONSIGNED A GUN **HAS NOTHING TO DO WITH ANY PURCHASE YOU MAKE FROM SOMEONE ELSE**


                              Your purchase will be a normal purchase like every other, with a standard 10-day wait after you DROS. You can start the paperwork the very day you meet the seller, and come back 10 days later for the gun.


                              1) Go to the store, meet the seller, pay him and DROS
                              2) Come back 10 days later for the gun

                              It is that simple. 10 days. 1 2 3 4 5 6 7 8 9 10 days. 10 days start to finish.
