    Aren't PPTs required by Ca Law?

    Hi All,

    If this question has addressed here already, I apologize because I couldn't find it.

    I am trying to get a private party transfer for a handgun and was just told by an open and operating Bay Area firearms dealer over the phone that they are "not doing PPTs until the COVID thing is over and the masks come off". When I very politely reminded the person that they are required by law to provide PPTs, she hung up on me.

    As you can imagine, that frosted my tail a bit and I intend to report this FFL to the DOJ unless someone here can offer a reason why I should not. Seems to me like they are making money and not fulfilling a legal requirement that comes along with that.

    Any thoughts? Am I mistaken?

    If they sell handguns to the public, then yes, by law, they must do PPT.

    If you were to name the FFL, the CG community can probably give you some better feedback on them.

          I honestly wish we didn't have to do them. Waste of time, we actually lose money (cost of labor, paper, ink, time, vault space, etc) on each one. Plus they are mostly one giant headache. They are missing paperwork, argue about high cap mags, argue about locks and cases, argue about what is and isn't 2nd proof of residency, I could go on and on. Then you have the know-it-all guys who try to tell me how to do my job and get all "I'm gonna call DOJ on you!" When you don't agree. Not worth it at all.

              I think what got me riled up up was the way the shopkeeper just hung up on me while I was making a very conscious effort to be polite. I know that the PPTs are a waste of time and resources for the FFLs and I have empathy for that.

              Additionally however, I will say also that I have done hundreds of bread and butter transfers and consignment purchases from FFLs and this would be only my second PPT in my lifetime. Would hope the the FFL would return the favor, but not in this case. So...I get to drive an additional 60 miles twice for the same transaction. Also, hasn't COVID been a positive for the gun dealers? I certainly don't think it is hard times when I look around at the empty shelves, but maybe I am mistaken on that point.

              I will never darken the doorstep of that vendor, that is one thing I can say for sure.

                Penal Code section 26825:
                A licensee shall agree to and shall act properly and promptly in processing firearms transactions pursuant to Chapter 5 (commencing with Section 28050).

                Chapter 5, including Section 28050, is the Chapter of the Penal Code about Private Party Transfers. However, if the dealer doesn't sell handguns, there's a little wriggle room.

                Penal Code section 28065:

                Notwithstanding any other provision of law, a dealer who does not sell, transfer, or keep an inventory of handguns is not required to process private party transfers of handguns.

                If AB2362 becomes law, I expect that a lot of stores will start getting fined over not doing PPTs promptly.

                  I wonder...if we (NRA/CRPA/GOC/NSSF/whoever) could get together and start a movement to utilize Firearm Ownership Report (BOF 4542A) on transfers.

                  Of course, we pay $19 to the state, but that would make PPT's so much easier. If I can buy a C&R rifle/shotgun (as an 03) without going through an FFL, why not expand the law?

                  The form already has a spot for receipt from a private party.

                  Yeah, I know what the penal code says, and this would require a legislative amendment to the penal code, and a legislator with backbone to introduce it, but -aside from this sick state's "hate guns" mantra, we could at least try. I know the FFL's would support it.

                  Just a thought.

                    Yeah.. vendors do that because they're almost certain that you don't have the "stones" or are willing to take the time to call them out on public forums.

                    You can bet that if these rude vendors were getting called out publicly, they'd have a far more friendly attitude towards doing what's required of them.

                    So what are you gonna do? Are ya going to name them, or just keep letting them treat people just like they treated you?

                      Every firearm must go thru database in case of stolen weapon. How would that work? Everyone selling or buying firearms must have coe. Everyone must have fsc or equivalent and a safety card of some kind to circumvent the safe handling demo.

                            Always good to have the AG’s official position on this available for discussion:
                            Firearms dealers are required to conduct private party transfers pursuant to Penal Code section 12071(b)(5). Dealers may not limit the days or hours in which private party transfers are conducted.
                            And that’s been unchanged (other than PC re-codification) for almost 20 years.
