    Kemasa correct no sales tax total should have $47.19 plus the lock. Mattcool got gipped. What ffl was this.?

        Was this a CA PPT where both the buyer and seller went to the FFL to do the transfer and both are CA residents? This is the only way the fees are limited.

          Matt - the FFL for reason of their own charged you sales tax on $47.19 and lock. There is NO sales tax on ppt but some ffl make up their own rules in saying "my accountant/bookkeeper says to charge tax".

          Normally is just $47.19 (DROS $37.19 + $10) unless they disclose a additional fee which most does not do but Turners has their own $5 service fee.

          The lock you guys brought, was that lock purchased within last 30 days and have receipt? If not, FFL can make you purchase one of their locks. Some mfg comes with a factory lock and some ffl will accept that but not all.

            Well, this is lovely.

            Back in 2011, kemasa linked to a Board of Equalization document that clearly states the DROS fee should not be taxed; now, the link to the PDF doc is broken.

            Also seems to me the Firearms Dealer FAQ used to say DROS fee is not taxable; that is gone, and in the public FAQ, regarding tax on DROS, it says see the BOE website.

            Searching BOE brings up a link to "Sales and Use Tax Annotations - 495.0843" but it's broken (may be the same doc in kemasa's 2011 post) , but it IS available here - https://www.cdtfa.ca.gov/lawguides/v.../495-0843.html - so I think they just moved it and allowed links to break.

            Anyway, this bit is still there:

            (Note: On and after January 1, 1999, the Department of Justice fee is not includible in the measure of tax, but all other charges remain subject to tax.)

              Maybe because the "Board of Equalization" doesn't exist anymore??

              I've seen that it can take more than a little time for an agency name change to "fully complete" due to all of the changes required in documentation.

                  100% both CA residents. We both went in. Buyer (myself) and Seller were both present. Check, Check, and check.

                    The other 12dollars and change was never disclosed, and invoice just says 60-ppt fee. Lock-5, tax, etc. The lock was clearly presented next to the firearm when Dros’ing. He never asked about the lock, just threw it on my invoice and threw it on my total. So I was shocked when given the total amount of 71.50. When asked he said they charge him 25 or 35 dollars, then the lock as required by law, and tax.

                      The dealer is actually charged the $37.19 by the CADOJ, so it's just a pass through. The Dealer Fee of $10.00 is theirs to keep.

                          Post up an itemize receipt let me see. Were there signage in the store somewhere about extra fees on PPT's?

                          At the end of the day, don't use them in the future!! There are plenty of other FFLs that only charge $47.19 and not too hardcore on the lock if one is present.

                                There can not be any extra fees on a CA PPT if it is picked up within 10 days. Storage can only be charged after 10 days.

                                If a CA certified lock comes with the firearm, then no lock is required to be purchased. It isn't a matter of hardcore, it is a matter of law.
