Sell Handgun to 03 FFL?

    Sell Handgun to 03 FFL?

    To the guys involved in sales. I am selling an Ithaca 1911-A1 on an auction site. Can I sell/ship/transfer the gun to an 03 FFL? I have an 01 but carry a CA exemption so I am not up to speed on sales.

    No, it has to be transferred through a dealer. A C&R FFL holder can acquire it while out of state and then bring it in and fill out the required paperwork. There are some exemptions for C&R long guns in state.

      In CA all hand gun sales have to go thru a FFL-01. I have an 03 and in CA one can't just have it shipped to them direct

        It has to go through a dealer. The FFL could have an 07FFL, or a pawn shop with an 02FFL, not just a 01FFL.

          Depends on where your customer is. California it has to go to an 01. But in most other states, an 03 can directly purchase a C&R handgun.

            Valid point, although I think most assumed it was a CA buyer and it might be, but perhaps not.

            You are incorrect about having to go to an 01, that is just one of several licenses that a dealer can have and it has to go through a dealer, regardless of which license they happen to have.

              Thanks guys. I dont know which state the guy is located. Just gettig prepared. So, if a guy with an 03 in another state wins the auction, can I send it directly to him, or must it go to an 01, 07, 10 etc?

                  Can ship direct to 03-FFL.

                  Unless the 03-FFL is located in CA, HI, NJ, or NY; then it needs to be shipped to a 01-FFL in their state, who will then transfer it to them.

                      How about NV? I heard that there are some new laws over there and they left out some C&R exemptions.

                      Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

                        NV laws change next year.

                        Starting 01-02-2020, all firearm transfers must be done through a NV FFL dealer.
                        Exemptions to this are:
                        1. Gov/Mil/LE agency to authorized employee for official/duty use.
                        2. Transfers of antique firearms, defined under Federal laws/regulations.
                        3. Transfers between immediate family members.
                        4. Transfers to the executor of an estate by the deceased owner.
                        5. Temporary transfer to a non-prohibited person for protection against immediate death or great bodily injury and the transfer only lasting until the danger is no longer immediate.
                        6. Temporary transfer to a non-prohibited person at an authorized location/event/activity and the transfer only lasting until the even/activity is ended.
                        6A. At a licensed shooting range.
                        6B. At an organized/sponsored shooting competition.
                        6C. At a public performance by an organized group.
                        6D. While hunting or trapping in areas where it is legal to hunt/trap by a NV licensed hunter.

                        Since, there is no C&R exemption to these laws, all C&R firearms must be transferred through a NV FFL dealer.
