You have stated it correctly and I definitely understood your question, military police cannot buy brand new off roster guns like a standard police officer would.

The penal code seems to say military can buy just as police can (letter of the law) but the DOJ’s opinion is that it is LEO only and doesn’t think military counts (their opinion on the letter of the law). Don’t know how they would argue in court that pc 32000 doesn’t include military when it basically says “all these departments and the military can buy them for duty, sworn members are not prohibited from buyin) and have no problem with the individual officer but the soldier is different somehow. Problem is the guys who write the dealers up for breaking the law have “opinions” and there isn’t much we can do but spend tons of money in court trying to prove to a biased judge the DOJ isn’t playing fair and it’s just not worth it.

Exactly this, I argued with him for a while but it's just not worth the write-ups. I also think it's legal but doj specifically says no so... Here we are

I wrote a very strong argument to the DOJ about “sworn members” buying firearms and my request for clarification has “been with the lawyers” for 6 months.

Sounds like my very strong argument for the Colt National matches, but by the time the lawyers get back to me I'm sure that ATF will change their definition and it will all be a moot point anyway

I thought FLEOs were just added fairly recently (like maybe a year or two back) when they added the classes of LEOs who could resell.

FLEO's are "Tier 1" and have always been able to buy/sell without issue. The primary problem here is that CA doesn't consider MP's as FLEO's. Only properly credentialed FLEO's such as AF SIO, Coasties MES, maybe CID, etc... are considered as such since their ID's advise of arrest powers and ability to carry firearms in the course of their functions.

For the most part, if you fall under LEOSA, you're classified as exempt. MP's aren't properly credentialed to fall under LEOSA because the Army hasn't done it yet.

By LEOSA, I assume the statute means active LEO. Retired LEO are under LEOSA as well, but we cant buy off roster.

Yes, correct, I am referring to active duty under LEOSA as a general guidance. The two laws having nothing in relation to one another. It is simply a quick reference.

ok just spoke with my actual DOJ rep not there customer service line. the person who conducts my audit.

she said that MP cannot buy any off roster hand gun UNLESS! a law letter was given by their superior. she stated that they typically get there off roster weapons from there issuer ( military ) and that is the reason they cannot just go out and buy off roster
