Release on Undetermined - FFL Liable

When they give us the deliver button and the "you can release" letter they are begrudging giving us the OK. We know a Federal check has cleared them (Hence the NICS number).

I hate to show my ignorance but I'm a bit confused by this statement. I've never seen a NICS number. I enter the DROS number in box 19b of the 4473. I've always assumed the DROS number was the CA substitute for the NICS number. But a DROS number is assigned immediately upon submittal of the DROS so getting a DROS number can't indicate the buyer has passed the Federal background check.

What am I missing?

If the final disposition comes back (via letter) as "undetermined" there 'may' be a NICS number written in by hand on the Undetermined letter. If you don't get that number you should call the DROS Entry phone number and request the NICS number...and write it in on box 19f of the 4473 form. The 'name' apparently is not important. As I understand it.

Have you ever had an Undetermined? If so after the 30 days its illegal Federally to release without a check done. CADOJ runs a NICS and sends you a letter with the NICS number hand written on it. (It will look like 100Y32X4J).

To comply with federal law you are suppose to check the Delay/No Response given with XX day boxes/ Write in the new date and NICS number.

There has to be a background check within 30 days in order to be able to release a firearm. If the status is undetermined, that occurs after 30 days, so the DROS number isn't acceptable as it is over 30 days, so you need an updated number, which is the NICS. They also give this same number in the case that the buyer is denied on a CA PPT, which is what is used to return the firearm to the seller as the 4473 is required to return the firearm, but not an additional DROS.

Nope, I've never had an undetermined. That makes sense now. Thanks for the clarification.
