The pistol is a bolt action repeater. (Not a single shot, not an exempted pistol.) It was drop tested by the State certified lab, after we specifically engineered the FCG to work effectively for the drop testing. After that, we explained the paradigm to CADOJ, and they were nice enough to place it on the Roster.

Since this is the FFL forum, I'll mention that this Pistol is available through direct account or via distribution in the next week or so.

While I agree with you, it seems like CADOJ has a hard-on for SSE. That is why we pioneered this new avenue.

Not at this time. We will have to work on that in the near future.

So can someone actually cite the wording in the PC that prohibts changing a single shot to semi auto AFTER it's been delivered via DROS as a true SSE AR pistol? Not being sarcastic, I'm genuinely curious!

I believe that they hang their hat on the definition of manufacturing.

I love how they say "May" and reference entire sections of the PC, nothing specific So if you change anything on a legal pistol roster or SSE1/SSE2, its now manufacturing? What if I take off the loaded chamber indicator on a Shield after DROS? Did I violate 31910(4)?

                        Here is what DOJ Says:

Alterations of a single shot pistol (i.e. changing upper receivers, connecting gas tubes) may also be considered manufacturing an unsafe handgun. See California Penal Code sections 31900-31910 for the definition of unsafe handguns and 32000(a) for more information on illegal acts involving unsafe handguns.

does that mean this is true also?

                          Agreed.

Although there's a counter-argument this is distinguishable because you manufactured a new handgun out of state, which you then brought in. The proper analogy then would be "can you take a glock 19, go to Arizona, add an Apex trigger to it, thereby manufacturing a new, unsafe handgun, and bring it back to California?"

Even assuming this manufacturing theory ("any manufacturing creates a different firearm than the one it was before") holds up, and I doubt it does, to prove an importation charge, the state has to prove beyond a reasonable doubt that you made the modifications out of state and brought the firearm back. To prove the unsafe handgun manufacturing charge, it has to prove that you made the modifications within the state. It's virtually impossible for them to do so absent self-incrimination.

I'd bet (if betting is legal?) that there will be no prosecutions for adding a gas tube to an otherwise legal, fixed mag pistol.
In case it wasn't obvious, nothing I write here should be interpreted as legal advice.

Sure, but what they don't have to cover is your attorney fees, and months of headache, and still possibly losing your case and livelihood. I'll pass.

It's a non-prohibiting misdemeanor that has a good chance of being tossed before trial or pleaded to a fine with no jail time.

Although I recognize it may be different for an FFL in terms of what it does to your ability to maintain your licenses (not sure if it is).

Have we ever seen DOJ or a local DA bring a misdemeanor gun case where the legal theory is as strained as it is here, and they have an evidentiary problem proving one of the elements of the charge.
