You are dead wrong. You clearly have no idea whatsoever what you are talking about.

A person moving into this DOES NOT go to a FFL with their guns. A person who was at some point in their life gifted a gun, DOES NOT GO TO A FFL with them to check in, register them, etc.

A person moving into this state with guns as a new resident MAILS IN A FORM OR COMPLETES IT ONLINE. At that point the DOJ will do a thorough state and federal background check on that person. They will not be impressed if they find out you always were living here.

A person who is being gifted a gun via a FFL transfer CANNOT HAVE THE GUN FIRST. That should be obvious. The gun must arrive to the FFL by mail, usually from another FFL, or in limited cases the person GIFTING the gun from out of state must show up in person with the gun to be gifted.

Second question, my coworker just visited his military son in North Carolina where he was gifted an off roster gun. Drove to California with the gun and a letter of gift. Then went to an FFL to register the gun and do the 10 day wait. SO either YOU are totally wrong, or my coworker, his son, and the California FFL are all going away to prison. Hmmmmm,,,,, maybe you're not the one to answer this question.
Finally, I just wanted to point out the purpose of this forum, "open discussion to ask polite questions of an FFL." I felt my questions were polite, and would have preferred open discussion, explaining the laws, background procedure, and where the existing laws are useless and/or unenforceable.

There is no legal requirement for the CA FFL dealer to assist the new resident.

The CA FFL dealer would most likley refer the new resident to the CA DOJ BOF website, where they can either download the required CA DOJ BOF form or utilize the CA DOJ online reporting system.

Because the father (CA resident) and the son (NC resident) transferred a firearm between themselves while in NC, they both committed Federal felonies. [18 USC 922(a)(3)&(5)]

The father (CA resident) then committed a CA felony by bringing the handgun into CA. [PC 27585(a)]

The CA FFL dealer was doing the father a solid by (most likely) processing the transfer as if the firearm was shipped to him.

If CA DOJ BOF and/or BATFE discovered what really occurred, then both the father and son would face legal charges and the CA FFL dealer would have their FFL revoked.

Thanks. I'll have to share that info because I can imagine others following his example with family in Oregon and Arizona. It answers my original question because the way you explained it, the FFL bears no burden to determine how long someone is in California. I will just imagine that somehow the DOJ will just know if a gifted gun is from your actual birth mother, or just some random woman, although I doubt they actually look up the family tree of every person that receives an out of state transfer.

Yea skyhawk, the issue was already explained, but thanks for your chicken little reply. Just a side thought. You all know the second amendment was written so citizens would have the ability to fight against a government that was taking our constitutional rights away. So here we sit as a state government attacks our constitutional rights, and the very people who always scream about the second amendment seem to be the first ones that want to point fingers at who is doing something wrong, and who is not following the new laws as well as they are. Kind of ironic right? I mean, when will all these second amendment lovers actually get around to fighting for their rights, either in court or with the very guns that were guaranteed just for that purpose? I guess for some guys like skyhawk they will be waiting to get a gold star next to their name for how obediently they kneel to the regime that decides we don't need any guns. Hopefully there are a few more like myself, willing to question the laws and think outside of the box.

Usually asking questions and learning is the right way to handle things, but hey, great reply! I'm sure you are happy to see your post count numbers go up even if everything you say is useless.
