10 day exempt

I have a handgun on layaway at a LGS. They told me they are a 07FFL. I informed them I’m a 03FFL C&R/COE holder. They said because of the type of FFL license they hold they could exempt me from the 10 day wait. The gun is not a C&R. They said they do this all the time and know what they’re doing in this regard. I think they’re wrong but if they haven’t gotten dros kicked back from this I don’t know what to make of it. I want to use my C&R/COE mainly to be exempt from the 1 in 30 new hg purchase. What should I do?

Personally I'd ask them to show you where they got that info. Now I'm not sure if it's still in effect, but when you go through the C&R steps to exempt the 1 in 30 the DROS print out did says that the waiting period is also exempt... Kinda a glitch in the system, but several folks have called the DOJ and the 10 day should still be in effect. I haven't heard anything new on the subject, and don't know whether they've fixed it or not... As far as being a FFL7 I don't know of anything that would be different.

They're wrong, and being an 07 has not impact on the matter. IIRC there is even a DES bulletin about it. The 10 day exemption for FFL03 + COE holders is for C&R guns only and not "modern guns". There is a glitch in DES that enables the deliver button when a C&R holder is being exempt from 1:30, but the dealer is supposed to make the purchaser wait the 10 days before delivery.

The DROS will most likely not get kicked back, but the dealer will be found in violation during an audit if the record is pulled.
