    Intra-familial Transfers Help please

    My step son lives in CA and I want to gift him S&W Model 15 that is not on the Roster. Since he is my Stepson I assume that I could transfer the pistol to my wife and then she can then use the Intra-Familial Transfer as a way around to getting my son the pistol correct? We Live in PA as an FYI and thankfully cling to our Religion and Guns!! hahaha.

    If the above is correct what then what is the process of getting the pistol to him? Can I ship directly to a FFL Dealer? What Paperwork is required, etc?

    That would work as you are not fmmily legally for this purpose. Fiream must go to ffl here from her and her id and a letter stating gift must accompany. He needs fsc and picture ca id and second verification of currnet address.

      1. You need to legally transfer the firearm to your wife in accordance with PA laws.
      2. Your step-son will need to find a CA FFL dealer that knows about and is willing to do an out-of-state intra-familial gift transfer.
      3. Your wife will then deliver the firearm along with a copy of her PA DL/ID & a gift letter to that CA FFL dealer.
      4. That CA FFL dealer will then transfer (4473/DROS/10 day wait) the firearm to your step-son.

        How would I ship the firearm to the CA FFL Dealer? Just UPS fedex whatever?

          Depending where son lives we can do it assuming coming from wife as Quiet documented. Shipping options are:
          UPS - follow their policies (next day air, declared, must ship from hub)
          FedEx - follow their policies (next day air, declared, must ship from hub)

              He's in PA - think of how difficult this garbage is for us when we live here, then add 2300 miles plus a rational reaction of disbelief ...

                Yeah well I was pointed to this forum from my S&W forum where I am a member. I don't have time for BS and I don't do BS. Things here in PA are so much easier gun wise. The amount of incorrect info you can get from forums is amazing and what I received from the S&W forum was some good and some really bad. This is all new territory to me so if I offend anyone with my questions then I apologize. I never sold or gifted one of my firearms and am in the process of gifting some of them to my 6 kids who live from NY to CA. I had some of them in my will but why not let them enjoy now!!

                        Wayne,

                        As I understand CA gun laws, a firearm can be pass down from parent (not sure if it has to be birth parent) to child without going through Firearm dealer. The parent (including out of state) can send the firearm directly to the child (over 18 years old for rifles or 21 for hand guns). Then the child must fill out the California department of Justice form for the transfer with $15 (can't remember exact amount of my head). However, the rifle must be california compliant before it enters california, it must have a bullet button.

                            Incorrect - follow Quiet's post above and not this one or you'll get in trouble. As note in the link posted by phongvu:
                            The exemption does not apply to step-children/step-parents, brothers, sisters, aunts, uncles, or cousins.
                            Also, that STATE link is not to be applied to Federal law.

                              The California DOJ knows NOTHING about federal law in this context so any information received from them is meaningless.

                              A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm or ammunition, prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm and requires obtaining written acknowledgement of receipt.

                              [18 U.S.C. 922(a)(2)(A), 922(a)(5), 922(e) and (f); 27 CFR 478.30 and 478.31]

                              922(a)(1)
                              (a) It shall be unlawful—
                              (1) for any person—
                              (A) except a licensed importer, licensed manufacturer, or licensed dealer, to engage in the business of importing, manufacturing, or dealing in firearms, or in the course of such business to ship, transport, or receive any firearm in interstate or foreign commerce; or
                              922(a)(5)
                              (a) It shall be unlawful—
                              (5) for any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) to transfer, sell, trade, give, transport, or deliver any firearm to any person (other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector) who the transferor knows or has reasonable cause to believe does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the transferor resides; except that this paragraph shall not apply to (A) the transfer, transportation, or delivery of a firearm made to carry out a bequest of a firearm to, or an acquisition by intestate succession of a firearm by, a person who is permitted to acquire or possess a firearm under the laws of the State of his residence, and (B) the loan or rental of a firearm to any person for temporary use for lawful sporting purposes;
