    Shipping a rifle.

    Can a local FFL1 accept a gun shipped from a private party to do a DROS, or does the gun need to be shipped from another FFL1??

    Or would the PP need to take it to his local FFL and have it shipped from there??
    WITHOUT THE 2nd THERE WON'T BE A 1st...]

    Yes and no. Also if handgun must be on roster unless single action sse. Need to contact receiving ffl for ok some won't do it for own reasons. Nothing to do with legality.

      I think you mean SAE. SSE is over now unfortunately.

          It is up to the receiving FFL, some will accept from individuals and other will not.

          Shipper needs to include a copy of their drivers license and if out of state invoice.

            No law requires it. A particular FFL may choose to do business that way.

            Sometimes that is less expensive.

              For handguns, it can be cheaper to ship it through a FFL depending on what the FFL charges. FFLs can ship USPS, whereas non-FFLs have to ship handguns overnight using UPS/FedEx.

                  There are restrictions with single shot firearms, but the exemption still exists. You can not convert a semi-auto to single shot though.

                      First check and see that a dealer will accept from a private party. If they will then ask them if they will charge you sales tax on a private (no dealer involved) transaction. If they will move on to the next guy. My receiving dealer requires a copy of the senders drivers license and a statement that it is a casual sale between private parties with the gun make/model/sn and no price listed. Also shop for their price for receiving my guy is $25 to receive and $25 for DROS.

                          The view of the CA BOE has changed and with few exceptions, the FFL is required to pay the sales tax if the firearm comes from out of state. The dealer IS involved because they are receiving it and processing the transaction.

                          Suggesting that people do business with those who either are not aware of the law or choose to violate it is not really a good idea. This is a public forum and there are those who are watching as well.

                          When your FFL get audited, there will be a world of hurt. You could do your FFL a big favor and educate him/her, but then you would have to pay more and perhaps you don't care what happens to them.

                            If your dealer needs proof have them contact the BOE. I contacted the BOE and over a 3 month period with a lawyer trying to argue what we all believe SHOULD be the law (no sales tax from private parties). However, as Kemasa pointed out, with very FEW exceptions any firearm coming from out of state will require the CA FFL to collect tax on.

                            Also, audits do happen. I'm a small shop (appointment only) and was audited last year by the IRS. If you want your FFL to stay in business educate them.

                            Here's the direct quote from my correspondence from the BOE (Reference: F09-07- 121FU5 Dated April 12, 2016):
                            Pursuant to the California Sales and Use Tax Law, Federal Regulations and the additional citations that were provided to you in prior emails, when a California Federal Firearms License (FFL) dealer (California FFL dealer) completes the registration paperwork and delivers a firearm to a California purchaser for an out-of- state private party seller or an out-of-state retailer not registered with the BOE as a retailer engaged in business in this state, it is presumed that the California FFL dealer is the retailer of the firearm. This is due to the fact that by operation of law, only the California FFL dealer possessing the firearm has power to cause title to the property to transfer to the purchaser. Thus, as the retailer in such transaction, the California FFL dealer owes sales tax on the total amount of the sales price of the gun including their service charge.

                              Thanks all for the advice. Unfortunately both dealers that I use for PPT's said the same thing, in that they will only accept a shipped gun from another FFL1. I have a feeling that they are not unique. Shipped from a PP there are all sorts of issues that could possibily crop up. Phony ID and a Hot Gun scam are just a couple I can think of... So I'll continue to buy from local PP's, and do a face to face with a local dealer....
