        Pacrat,

A swing and miss would most likely be a simple "Assault" (Penal Code section 240).

If there were some aggravating circumstance where the "swing and miss" was "likely to cause great bodily injury", the the proper charge would be "Assault with Deadly Weapon/Force Likely to Produce GBI (Penal Code section 245(a)(4)).

In both cases, please note that, by definition, the "assault" is an attempt. Please refer to PC section 240 for the definition of "assault."

If they "swing and hit" and actually cause great bodily injury, the proper charge would be "Felony Battery" (Penal Code section 243(d)).

If you build a man a fire, you'll keep him warm for the evening. If you set a man on fire, you'll keep him warm for the rest of his life.

I should check the box marked "FAIL" for attempted humor. As we all know, there is a difference between actual Humor and Attempted Humor. My attempt obviously fell short. Faceslap for me.

              Pacrat,

Don't feel bad. I've been accused, more than once, and legitimately so, of having missed sarcasm and humor in previous threads.

I guess I just gotta stop being so serious all the time.
