Question for LEO regarding condo tenant. *updated*

I have a question regarding a tenant within our condo complex.

It's going to be difficult to address your issue.

If the other tenant is an owner of a unit in the complex, and it's a traditional Condo development, then he likely owns the interior of his unit and an "undivided" interest in the common property. If he's occupying the common property when engaging in his objectionable conduct, there's not much recourse. It's his property too.

The Condo Association may have some ability to regulate his conduct according to the CC+R's governing the development. That a private contract. An LEO is not empowered to enforce the terms of the private contract.

If he is occupying the interior of the vacant unit when engaging in the objectionable behavior, then the property owner can take action to have him removed.

If he does anything illegal, like lewd conduct, then you can take enforcement action. But just being an old-fashioned jerk isn't illegal.

How is he getting access? Next time you see him, call the local PD and report someone has broken into the vacant apartment, let them sort it out. If nothing else I bet it will put a stop to it.

He hasn't broken into the condo unit. He's in the carport of the vacant condo across from our unit.

He's always there. Every time we come home or are at home he will mosey on over and sit in the middle of the carport and stare up into our unit.

The guy lives in a unit not even near ours.

Oh, you did'nt say that he was in the vacant units carport, but still. Does he have permission to be there? Call them. He's acting suspicious. Its not his units carport. He may be completely legit, but since you haven't or won't ask him what he's up to how do you know?

How about some old fashioned...go down there and ask him nicely to move because he makes your lady uncomfortable? If he gives you attitude, ask him again..nicely..if he is as much a jerk as you say he is, you may get lucky and he will get up and push you or try to hit you...Then..hopefully...your problem will be solved..providing you do your part of course..

Depending on where you live and the department time where you live at, but you can always call in a suspicious person. Give the officer cause to come out speak with the guy and maybe run the guys name see what pops up on this guy.

Sometimes people don't realize how odd they are acting towards other people.

Not being there to observe for myself, maybe contacting him first isn't a bad idea. But I would want a neutral witness, and since it is in public, I'd record the contact to provide proof of what each of us did or didn't say and do during that contact.

If that doesn't help, I'd at least call in it and get some documentation started. Keep a log. Some people dislike it when you take their picture or video of them - then they go away. He is acting wierd, strange, and aggressive (even if it is perhaps more passive than "actively" aggressive). I'd be concerned for my family though.

And yeah, being a jerk isn't illegal. If that is all it is, then use him as a witness if something bad does happen.
