    Can you identify a type of civilian that can legally possess an automatic knife, i.e. switchblade????

      You are quite correct that there is no exemption for LE.
      There's an exemption for active duty Military and Fed Officers while both are on official duties. 15 USC 1244.

                Good point, but it only appears that 15 USC 1244 creates an exemption from the provisions of 15 USC 1243 and 1242 (governing, among other things the possession of switchblade knifes). I don't see any language in there that creates an exemption from the Califonia Penal Code for federal LE officers. The only language I see in there addresses contract carriers, military and folks with only one arm (????). I do recognize that other federal law provisons may allow federal LE and military to possess, and those federal provisions would trump the penal code.

                Here's the full text of 15 USC 1244:
                Sections 1242 and 1243 of this title shall not apply to -
                (1) any common carrier or contract carrier, with respect to any
                switchblade knife shipped, transported, or delivered for shipment
                in interstate commerce in the ordinary course of business;
                (2) the manufacture, sale, transportation, distribution,
                possession, or introduction into interstate commerce, of
                switchblade knives pursuant to contract with the Armed Forces;
                (3) the Armed Forces or any member or employee thereof acting
                in the performance of his duty; or
                (4) the possession, and transportation upon his person, of any
                switchblade knife with a blade three inches or less in length by
                any individual who has only one arm.

                  I found this on the Benchmade website under restricted sales:

                  18 USC 1716 (G) (2) (1-4) provides this summary: Switchblade knives can be shipped to civilian and armed forces supply or procurement officers and employees of the Federal government ordering or procuring or purchasing such knives in connection with activities in the Federal government; to supply or procurement officers in the National Guard, the Air National Guard or militia of the state or territory of the District of Columbia ordering, procuring or purchasing such knives in connection with the activities of such organizations; to supply or procurement officers or employees of the municipal government of the District of Columbia or the government of any state or territory of any county, city, or other political subdivision of a state or territory ordering, procuring or purchasing such knives in connection with the activities of such government.

                    My department "range store" has these for sale. But what I don't get is how they can sell an item that is not legal to have? I have gone over this very same discussion with our court liaison (he is a retired LASO Sgt.) and he says there is no exemption for lew enforcement officers in california for possession of a switchblade. I carried one for years until I figured out it was easier and cheaper to buy one of those S&W $10 specials from Big 5 and destroy that on duty.

                      The stupid thing is, when I went to those cheap Big 5 specials, I stopped destroying and losing those knives. They lasted me forever... but when I carried a good knife, it was broken or lost within months.

                        That blows! I carried a Boker switchblade for years and I was affraid I would break it or jack it up real good so I just used it for "soft" stuff. I got a S&W cheepo and that stayed on my thigh rig forever, I cut all kinds of stuff with it. That blade took a beating and I was very pleased. The down side was, I was expecting it to fall apart after a week so I bought 6 of them in different styles and they sat in the safe in the boxes!

                          You know... you could be my long lost twin brother.

                          I had a Ken Onion custom Kershaw which was beautiful with the laminated grips and a super sharp blade and I chipped it so I retired it after fixing it up.

                          Then I went and bought like 6 of those cheapie S&W jobbies at Big 5, took my sharpener to it, and oiled up the action. They all work very well and I have even given 1 away to my uncle who needed a knife.

                          I have a tanto point for everyday carry and the rest... sit in the original boxes in the safe... stupid thing is my more expensive stuff sits in my drawer. Don't know why I do that.
