When speaking about one of my prior arrests and the causes for it, I pointed out that police probably thought that I was gang related, which is why I was arrested and investigated. Is this an automatic DQ and should I just forget about hopes for working for this agency?

Try to look at it this way:

Service with a law enforcement agency is pretty much incompatible with gang membership. There are many different degrees of gang affiliation. BI investigators get that.

People (some) get wiser as they get older. Gang affiliation is not a permanent condition. You can grow past it. The mayor of Los Angeles was "gang affiliated" at one point in his life. BI investigators also get that.

The admission of "gang affiliation" isn't "good" for your application, but it's not a killer either.

If your background investigator found the same information without your disclosure - that would be a guaranteed killer.

I had a felony when I was 13. Went to court and had it sealed/expunged. I was able to get in the .mil and work for a PD. I legally own lots of guns and I work for the agency that arrested me when I was 13. Anything is possible if they want you bad enough. I suppose I was wanted bad enough which is why my choices when I was younger did not affect me too much long term.

I'd think that multiple arrests would send up more red flags than one, possibly gang affiliated arrest. But, that's just a guess.

I was a background investigator and later a background investigation supervisor. Became a cop over 30 years ago.

Yes, JUVENILE OFFENSES need to be declared, will be searched out, etc. We even look for non-detention "contact" cards. Some juvenile records will show as a "sealed" record which means something happened and we will look into it. Not all juvenile records are sealed, some are only sealed by request and/or court order and not everyone does it. Juvenile gang membership, affiliation, is something that is investigated because of the dynamics of gang activity by juveniles. Most cops know the minors are used as dealers, dope runners, scouts, gun bearers, etc. and juveniles do it all including gang homicides. If you don't declare and we discover ... no bueno.

Your relationship with your B.I. is important. If you have good communications with him/her, you will have a much better opportunity to discuss any issues which may arise but there must be a level of trust. A good B.I. knows everyone hits a bump in the road now and then growing up.

We sometimes will go to an elementary school to check something out. No two agencies, BI's, applicants, etc. are the same. Juvenile arrests can be hidden from most employers but not from those requiring higher security clearances such as LE.

If you were mistaken for being a gang member, affiliate, etc. and were shown not to be associated, did they actually "arrest" you (i.e., charged with a crime, taken into custody or issued a notice to appear, photographed, fingerprinted, etc.) or just hang on to you until you were cleared?

We actually have former gang members in active law enforcement. They have the tattoos to prove their prior street cred. People change, people reform.
