I don't know if you have any law enforcement experience in the civilian area, but stopping the thread is exactly what we were taught while in the academy. If stopping the threat took 10 rounds; so be it. If the suspect died as a result of us trying to stop the threat, that doesn't mean we were trying to kill that suspect; only stop the threat.
I have been retired for almost 9yrs. now, but I would surmise that is still taught in le academies. You would never want to testify in court that you were trying to kill a suspect as that could and probably would have a negative impact with the jury.
To answer the question you have a lawyer asking above, the proper response would be, "I was in fear of my life or an innocent person's life and I shot the suspect to stop the threat."
Deadly force may be employed if it is reasonable force and the totality of the circumstances warrant it. Employing deadly force does not mean one was trying to kill someone.
Monk, you were correct; you are not shooting the suspect in an attempt to kill them, you are doing so to stop the threat. The fact the shooting may result in the suspect's death does not mean you intended to kill them despite what tanksoldier may believe.
