    Home Defense Issues

    Got multiple questions here.

In short, a convicted sexual offender used to live at my house, but he got arrested six months ago for failing to notify SJPD about his new location. He recently got out of jail and is going to try living here again, but I don't want him to (neither does my girlfriend).

He's deaf and "a little on the slow side", and I'm afraid as to what might happen if he tried to force the issue. Only self-defense stuff I have is my martial arts training, a few martial arts equipment (bokken and whatnot) and rifle with ammunition. (30-30 Win.)

Also, my G/F and I pay half the rent on the house, with my aunt and cousin paying the other half. If we wanted him not to come in, but they wanted to, what do I do? There's a Hula Dance School next door to our place that has children's classes, so he might not be able to legally live here if his parole has a restriction about that.

Also, if he were to live here because my aunt insists despite possible parole violation (I will check with SJPD tomorrow), can I get in trouble for this?

Thank you to any and all answers.

If you can afford to, move out with your gf and problem solved. Find some new pro gun, non criminal roommates if you need to, or get a smaller place with cheaper rent.

If money was available, wouldn't be living with my aunt to begin with.

Sounds like your aunt has legal standing to invite him to stay - you're likely SOL. Contact his parole officer for any options having to do with his conditions...

If you pay half the rent on a house, shouldn't that cover the rent of an apartment someplace?

Avoiding the drama in the first place is your best move. Let your aunt and your cousin deal with the deaf sex offender.

Your Aunt is retarded, why she INSISTS to rent a room to a sex offender is beyond me. As others said, move out.

Did he pay rent while in jail? If not have the landlord evict him.

This would be something you needed to discuss with the landlord.

If he's invited in by a legitimate occupant of the premises, not much you can do beyond looking for a violation of his conditions of release and then calling LE.

                      Just get out.

                        Thanks for the advice guys.

There is another option, and that would be going to live with my parents if my aunt allows this POS to move in. Since we bring in half the rent, she'll be paying more herself, and be worse off. I hope she'll see that, but she thinks that she knows everything on every subject (we often come to blows on matters of law, an area that I have quite a bit more experience than her).

I checked with the parole office, but since he was released from the county jail instead of federal prison, he's on probation, not parole. And therefore, the only restriction he has on him is the one required by Megan's Law, which is he has to inform local police that he is now living within their area.

I don't like the idea of living with my parents, especially since they're in a somewhat remote area, but better than living with a child molester.

What are the conditions of his probation?

Is this your Aunt's boyfriend? Why is she so set on having him live in your house?

You can contact the probation department with a general inquiry. Explain to the PO what the situation is at home, what is close by and the PO will figure out how that will jibe with the dude's terms of probation.

As noted above by others, I think your aunt has standing and could invite him in and not much you could do about it. If she is dead set on having the dude in there, it might be time to find other accommodations for you and your gf.

There is bad juju in it otherwise, I'd think.
