Jared, technically she would be in violation of 2800 cvc. Best advice is to begin to yield to a safe area on the shoulder unless your are either very near an offramp or you are instructed by the officers otherwise.

Ok cool, I think i'm gonna tell her to signal to the right and continue to drive to the next exit. i'll pay any fees that come with that. i just don't want her on the shoulder after what i have seen. Any LEOs want to add?

Tripper, the fact of the matter is that the officer will decide where you stop. Not exactly sure how cops in your area operate but if you kept driving (even safely) when I lit you up and waited to call dispatch (some agency do not even put their stops out over the radio) or drive to the local PD or whatever you will get taken out of the vehicle at gun point (true for most agencies I'm betting). Even possibly arrested for CVC 2800.

i'm not trying to be aggressive or combative (much respect to the leos) but i don't think i will decide to stop in an area where i feel at risk (or where i feel my wife is at risk) what is the punishment i can expect if i (or wife) don't pull over till off the freeway? i'm sorry, but all punishments aside, it's just not safe

I understand your concern. The most harsh punishment is you get arrested. You could also get cited for whatever the infraction was plus CVC 2800.

It is rare that I will not pull someone over at an off ramp. I have every intention of going home at night and, while I have made countless freeway stops, I am never comfortable standing on the side of a freeway. I would not bee too upset if someone drove to an off ramp unless I was telling them over the PA to pull over.

Yeah it really is a horrible feeling standing feet away from 2,000 lb hunks of steel flying at 65+l. A few weeks ago I got a flat on the freeway and had no choice but to stop on the left, I was by myself so the whole time my head was up keeping an eye out. Whenever I see anyone stopped on the shoulder I move to the next lane.

Last time I got stopped by the CHP I took the next off ramp, when he made contact he thanked me for pulling off. Though if there wasn't an offramp close I would start to pull on the shoulder until he/she says otherwise.

Of all the stops I pulled on the freeway, everyone of them has immediately pulled over and I have had to use my PA to get them to get off the exit. I hate conducting the contact on the freeway. Too many cars and I don't do passenger side approaches often and would rather get them off the freeway so I am not distracted by the cars flying by.

Yes...but not quite. As someone who makes a lot of freeway stops, for the love of God do not stop on the freeway! I see it all the the time, I will be responding to something code 3 in the far left (#1) lane. People will yield to the right hand lane or shoulder and stop. Then as soon as I pass them they will pull left and nearly get smoked by some nucklehead who did not slow or stop and was too busy watching me to see the cars in front of him.

Its simple, really.
On any non freeway (any highway), yield to the right curb and stop
On any freeway, yield to the right lanes and slow down.

If you are getting pulled over on the freeway you will know because as you move over I will follow you. At that point turn on your right turn signal so I know you saw me and continue moving safely to the right. If there is an exit within a reasonable distance I will always take you off the freeway. I have had too many friends killed on the side of the freeway and avoid it if possible. If I have no choice I will make a freeway stop. However I know the freeway like the back of my hand and I know where the safe and wide shoulders are, I will direct you to those locations. So.....turn of the radio, roll down the window, listen for instructions from my PA.

If I have you yield to the shoulder, pull as FAR off the road as possible; the dirt is not going to hurt your car, the semi doing 70 will, (see video)

PS also, nevernevernevernever pull into the center divide. Always move right.

I know that, that is why I will simply say "GO GO" and state the name of the next exit. That is also why you need to roll your window down. If you hear me giving you instructions in Spanish, then you REALLY weren't listening to me!

So you intentionally park with no other reason than to force the officer to stand in traffic. Wow. I really am both speachless and disgusted.
