Generally yes. But there are cases where that was still questionable where the turd says he never meant to follow through and would have left without further incident and it went to an IA and even civil lawsuits.

So if a guy with a gun runs up to my car window, ponts a gun at me and asks me to get out fo the car and I shoot Him. Somone may say that if I gave Him the car , He would just leave me alone. Right?

Yes they will, they're called lawyers.

And if he get a good lawyer he might win a nice settlement against you in civil court. Criminal is one thing, if you acted right you should be alright, but civil is a whole other dog fight.

Especially as an off-duty LEO... the suspect's/suspect's family's lawyer sees an easy target with deep pockets. Sue the officer, the department, and just for good measure, the gun manufacturer that supplied the Officer's gun... they're bound to get an easy settlement somewhere in there.

So what do they have to do for You to be CLEAR, I mean REALLY clear from everything. ( IA, DA, Lawyers etc)

If they fire at you first, that's always a good way for you to come up on top later on when they file civilly. Notice I didn't say IF they file, but rather, WHEN they file.

There will always be a civil filing when a cop is involved. Race pimps and ambulance chasers will always find these families and file something and hope it sticks. That is the nature of the game.

If he fires first, he doesn't have to hit you, and you would then be pretty justified in responding with deadly force. However, just be prepared for the nightmare afterwards, starting with the OIS investigation, Homicide investigation (if you killed him), and DA's inquiry. Then you get the fun that only a civil court can bring you.

This just in, an off-duty situation that went very badly for the officers involved. I hope the one officer recovers quickly.
