Do you do lab test for minors in possession of alcohol or open container in a vehicle to prove it's alcohol. My bet is that the standard of proof will eventually yield to the officers "expertise". At the most, a quick NIK test will probably suffice. It will be interesting to see what happens.

Requires 3 prior convictions.as a basis but then there are a bunch of other criteria for less than 2 priors. Sex registrants apparently still only need one prior. I don't have the memo I got at roll call handy.
It's pretty lame as a whole. All they are trying to do is lower the prison population but all that will happens is they will just go through one more step before going to prison. I don't think the politicians realize that the majority of the prison population in california are recycles.Comment

One more step.... and how many more victims.
They don't care.I don't think the politicians realize that the majority of the prison population in california are recycles.

Trickster hit on it. Instead of just allowing folks to dump it and get on their way when you are too busy to take papaer, book the weed, etc. Now, all you have to do is bang out a cite and then testify that you smelled the odor of marijuana. No testing needed. Before, in a car of four potheads, you would always try to get someone to admit possesion or put it on the driver. Now, cites for anyone who is buzzed!Comment
