I just made a midnite run to Safeway. On the way back, got pulled over and he told me stopped me because my registration is expired. The car's sticker says Jun and here it is August. So I handed him the valid registration card and told him I have the tags too. He checked, handed back the reg and then asked for my DL. "Huh? What's the point? Your entire PC for the stop evaporated the moment you realized my reg is valid." From the look on his face, you'd think he was passing a porcupine. I was glad he didn't push it... I had ice cream to get home.
You're wrong. You could have easily been cited. Failure to display your current tags is just as much PC as having expired tags.

He looked at me rolled his eyes and kept talking. I stopped him and he related to me that "talking on a phone is not PC for a stop, and it states that in the vehicle code." The section changed not the fact there was a violation. Once you have enough time on the job pretty much every car has something. I think it speaks more to the fact that I don't do a traffic stop unless it's worth it.Haven't made a mistake yet, huh?

He still had PC to stop you. Nothing evaporated. What matters here is the officer BELIEVED he saw your tags were expired when he first stopped you. As long as he is not lying and does not say he thought your tags were expired when in his heart he knows that to be untrue, having some other motive for the stop, it is a valid stop. Even you agree, the guy made an honest mistake. Lets take it further. Suppose you were drunk. Should he just let you go because he made an honest mistake stopping you when he thought he saw a violation? No, he will arrest you and then write in his report that when he first stopped you he thought he saw something (expired tags) which later turned out to be a mistake. Granted, the court case might be weaker than it should be, but it is still a good arrest.Comment

Attitude goes a long way but so does the circumstances of the stop. I stop a guy at 0330 for speeding 10 miles over the limit I may be just interested in what he's doing out and about at that hour.
Doing 10mph over through a school zone while school is getting out is something else all together. Either way I am never sure what I have and act accordingly. Most people are good folks who just made a mistake. However, its the other small percentage that keep me worried.
Oh and your mouth can get you into trouble, but remember what you do with your hands may get you dead.
