    Traffic school fraud

My wife is stressed beyond belief. Her job sucks and there is alot of things her boss does that are borderline illegal or just downright rude.

I'm pretty sure the boss knows jobs are scarce right now and is taking advantage of this situation.

Work situation: small office. My wife is the only employee. The boss owns the business. A two-woman operation.

The other day the boss comes into the office and told my wife her husband just got a traffic ticket and she needed her to complete traffic school for him.

Wife was shocked and didn't say much, avoided the topic.

Yesterday the boss comes into the office and again says her husband is not going to get around to doing traffic school and again tells wife she need to get it done for her.

I'm pissed like no other, and my wife is ubber-stressed. It must be some sort of crime to complete/perform traffic school for another person, 3rd party or not.

    What say Calgunners...?

(I did a quick google search for 'court traffic school fraud' but just a buch of rant topics about hating traffic school came up.

What the hell kind of office is this? Jobs aren't that scarce, the media hype makes them more scarce. Tell her to walk.

What a jerk. Online traffic school can be completed by any idiot with basic computer knowledge ONLINE in far less than one hour.

I would think that if she wanted her employee to perform some minor fraud, she would at least ASK first.

I've had bosses in the past that viewed me as their personal servant. (I was expected to give up my weekends to do yard work at his house.) But I've never had one that asked me to commit fraud for him

I say just do it and FAIL it on purpose. She only asked you to complete it for her, not to pass it. She'll be dumbfounded. That will teach her.

easy? yes. one hour? no. unfortunately the online classes have a timer and require you to stay on certain pages a set amount of time. Maybe there are different courses, but the one I took required at least 4 hours to complete if not more

I don't know the specific charges, but since this deals with a court recognized alternative sentence, perjury and fraud charges may apply. Even if there are no specific charges, your wife could face court sanctions by the judge or commissioner. It may be something that no one ever finds out, but it's not worth the risk. Your wife is in a pickle, either she breaks the law or probably loses her job. Job security isn't worth my integrity. I'd tell my wife to stand her ground, and try to get some tangible proof the boss is ordering her to do this. Without proof, it's going to be (s)he said she said. I would support my wife telling her boss to pound sand over this, even if it cost her the job.

+1 on the above. Integrity is worth much more in the long run. Like the above member mentioned, see if she can get some sort of proof that her boss is asking...wait...ordering her to commit fraud. I'm sure the hell-boss will back down once she realizes how much trouble hell-boss and her spouse will be if this was turned into the DMV. Good Luck.

Jobs aren't that scarce. What's scarce is qualified candidates.

I'd tell your wife to firmly and directly tell her boss that taking the exam for the husband is against the law -- it would be like serving jail time on his behalf. The court mandated that he take the course, not someone else.

                          The Quandry
Your wife has little to lose but her job and while jobs may be scarce, losing your job because you refused to commit a crime is no shame.

If your wife manages to get two other persons to hear her boss instruct her to take the test in lieu of the husband, then depositions to that fact can be entered in court in the husband's case. The judge can then do what judges do when such things happen. But in that case, your wife is likely to be out of a job.

If your wife pushes back and tells the boss she's asking an employee to commit a crime, she could be out of a job, given the personality of the boss.

Recording a private conversation in California is illegal unless both parties consent. However, given the good quality of cell phone mics today, if the wife's cellphone was "activated" while she was asking the boss about the legality of taking the test in lieu of the husband and the phone happened to connect to your office where three people heard it on a speakerphone... ... one can attest to what one heard in a deposition.

you should really report this to the labor board believe me the law is on your side also it is extremely illegal if there is any retaliation at all in the work place for reporting in good faith
