    Is it legal.....

For a guy to say he is a cop even though he is not and he is going around a flashing a badge? A guy in my neighbor hood has been harrassing the kids since yesterday and showing them a badge really fast but not long enough to read it! Then today he comes to my door yelling through the screen door that we don't know the law and flashing his badge to us but once again not long enough to read it! I ask him to show it to me again and he wouldn't. then I am telling him to get off my property and he is refusing! So I call the cops out (they already came out today already cause the same guy called saying that about 4 kids are threatening him with guns and knives) even though I know these kids and they are not like that and they don't own any weapons! When the cops came when I called the said that they can't do anything cause he is not gaining anything from supposedly flashing a fake badge! Is this legal? sorry for it being so long!

No, but it's up to the cops who resond to decide if he's impersonating an officer, or just being an idiot. print out the penal code that describes the penalties for impersonating an officer (no idea what number it is) and give it to him. Tell him if he flashes his badge at you again you'll call the cops and have a citizens arrest put on the guy, then you'll testify against him in court. It should calm him down. also, take pictures of it if you can...that's always a good thing to do.

Most civilization is based on cowardice. It's so easy to civilize by teaching cowardice. You water down the standards which would lead to bravery. You restrain the will. You regulate the appetites. You fence in the horizons. You make a law for every movement. You deny the existence of chaos. You teach even the children to breathe slowly. You tame.

          penal code section 538d.
          go to legalinfo.ca.gov
click on penal code and add secton above and enjoy reading the entire code section. The important part of the code is the use of a badge for a fraudulent purpose. Don't think your guy would qualify. Videotape him when he is flashing and talking about what he will do if you dont comply with his orders. Good luck

If I responded, I'd do everything I could to hook his sorry butt up for impersonating. If the elements of the crime weren't present, I'd make sure he saw the evils of his ways.

Yea, being generally a misdemeanor you may have to make a private person's arrest when the cops arrive. SOME of the guys who flash badges are harmless and clearly have cognitive issues. There are some like that who hang around the stations and earn a living shining shoes and leather, etc. Nobody in the world would believe that they were real cops, but they feel like they belong and cops tend to take them under their wing and act compassionately towards them. They memorize the police codes, know who works what car and what shift, etc.

On the other hand, there are those who try to convince the public they are LEOs and do so with criminal intent. They need to get hooked up. I've arrested impersonators, one of them actually tried to convince me he worked for my department when I caught up to him. I played along, letting him think we belived him in an effort to get him to sink his ship a little deeper. He had a fake badge, ID, business cards, toy gun, etc. He was conning stores, etc. and even sent official looking faxes telling the store security units he was working deep cover and not to approach him under any circumstance. Interesting and fun case.

Just heard that a 17 year old kid beat him up and he went to the hospital today! more details to follow. I know that none of the kids he was harassing this weekend were involved, this is a separate incident that happened today!

there's a guy who runs around our district who reminds me of this story
far as i can tell he's got a learning disability. the local merchants put up with him because he does try and help others, keeps an eye on things and stands by accident scenes attempting to redirect traffic to an open lane

i'm a firefighter so i appreciate someone wanting to help others. If you ask him, he'll hold open his wallet and let you see he has a photo id card and a police explorer (ride-along volunteer program) sticker.

found out he went to the park to take pictures of some kids that threw a apple at his house (supposedly the police told him to but that doesn't sound right) and while there he called this one guy a "beaner" and told him to go back to Mexico and the kid just pretty muched kicked his *****! Just found out the kid is 18 and did not go to jail for it!
