DMV form??? which one is it?

I used get this about 3-4 times every saturday when I worked for Sac County, when I was checking in vistors, but my current dept doesn't have them and I can't remember.

I stopped a guy for blowing through a stop sign last week, and he had 3 D.L.'s on him.... One was his new temporary D.L., one was his valid I.D. only, but the other was his expired D.L., which I seized.

My department now stated they just write a letter and send it in, but I know there is a form, and I don't feel like waisting 3 dollars worth of letterhead and envelope everytime we get one.

    Any help please!

did he have 3 DLs, or was it 2 DLs and an ID?

And what reason would you sieze his expired ID? When my DL expired and I had to go into DMV to have a new photo taken, they hole punched my current DL, gave it back to me, and gave me a temporary DL, and then sent me a new DL in the mail a couple weeks later. Just wondering why the old DL would need to be siezed. Why would DMV give me back something that was subject to siezure?

He had 2 dl's, one id card. one dl was TEPORARY, meaning paper and good for about a month, the other, the one I seized, was expired for about a month. Because he had an id card that was still valid, I let him have that and the paper d.l.

Your only supposed to have ONE d.l. or id card at a time.

really? I know that many people here have recommended that you have a CA DL and a CA ID. That way, if there is an issue with your DL, you can still DROS with your ID.

Off the top of my head, this one comes to mind:

CVC 12511. No person shall have in his or her possession or otherwise
under his or her control more than one driver's license.

When I take a suspended CA DL, I staple it to a DMV 310 form - not sure if that's the same one or not...

right, but if it is expired, is it still a DL?

If DMV hole punches my un-expired DL and issues me a new temporary DL, am I in control of more than one DL? What about when they send me my new DL? There is a time framie in which I now have a temporary DL and a permanent DL, neither of which is expred.

I don't see how the ID card even comes into play in this scenario.

Not at that time no, but as soon as you get your new one, you are supposed to return the hole punched one to DMV.

You have a reasonable amount of time to turn it in. example....I was driving behind a dodge hemi, when I watched the brake light go out....Later down the road, the couple stopped and flagged me down for directions. I informed them that their light had just gone out, and they stated they knew, as the computer told them it was out. Being that I watched the light go out, it would be unreasonable to cite them for it. Now if I had seen them the next day, and it still was un fixed, then a cite would be reasonable.

I don't see how the ID card even comes into play in this scenario.

why does someone need an id card and a dl?? In ca, they both use the same number, and the dl is also an id. there is no need for both.

              Answers are in bold....

I was not aware of that. I have never turned in an expired DL to DMV. Do you have the VC section that states that I must return an expired DL to DMW?

as mentioned before, if your DL is lost, you still have valid ID. Or if it is suspended (not that I have ever had a suspended DL), you can still use the ID card to legally purchase firearms.

When I go to the gym I leave my DL at home along with my wallet. I know my CDL# by heart, but I do have my old CDL with me, it has the expiration date punched out because I added the M1 to my license, I use the old ID wiht my gym pass because you are supposed to have an ID with you.

If you are driving, you can be cited for not having a valid driver's license in your possession. Presenting your expired license to a leo, even tho it is the same number, won't matter. Yes, he can verify your CDL is valid by running the number, but you can be cited for not having that valid one in your possession. Having a valid license to drive is covered by 12500a vc. Not having it in your possession is covered by the below section.

12951. (a) The licensee shall have the valid driver's license issued to him or her in his or her immediate possession at all times when driving a motor vehicle upon a highway.
