    Assault Weapon Registration

Okay here's the deal I am looking to upgrade my duty AR. Can I buy my stripped lower from any dealer or do I have to use someone with a specific license? I was looking to buy from a new dealer in town but was told if I did just a normal rifle sale through him I might have issues registering it as an assault weapon with DOJ.

You would go buy a lower reviver DROS is as a Long Rifle. Your rifle will no longer be a on listed assault Rifle because it will be a off listed receiver. Next you need to make sure its compliant no pistol grip if you have preban 30+ round mags or pistol grip with bullet button.

Welcome to Calguns LEO forum gbatch...I know you need your chief's letter to buy a turn-key AW that you send a copy to DOJ to register it as an AW but I don't know about just the lower receiver. Vendors that sell AWs to LEOs have CA DOJ AW registrations that allows them to do this, but that OLL would have to be sold by someone with the same CA AW registration but that brings the whole building/manufacturing an AW into question. It also probably depends on your dept policy and armorer for building up an OLL into an AW.

IIRC a brother LEO here on calguns mentioned in one post it was a PITA building a OLL and you are better off going turn-key from a CA registered AW dealer.

I bought a couple of stripped CMMG lowers thinking I would build them into duty rifles at a later date. I found out from here it's basically impossible to get them registered. You have to buy a full gun. From what was said manufacturing CA assault weapons is not legal. A few people had bought lowers from dealers with AW permits and got them registered but that's only because they slipped through the cracks at DOJ.

I found finding a dealer with an AW permit was not easy.

I know a dealer with a AW permit in San Diego if needed.

And I know an AW licensee in the north SF Bay area if the OP is around here.

Kind of a related question, I'm no longer a Copper, would I be able to make an AR-type rifle (with all the evil features) by piecing it together with an OLL and a BB?

IOW, build a rifle like people in free states do, but with a BB (so it's not an AW).

... Yes... Hundreds of thousands of people in CA have done that. Besides going featureless, that's the only way to have an AR here in CA...bullet button and a ten round mag.

ProForce in Brea and All State Police Equipment in Pomona are both AW dealers. Don't waste your time trying to register a stripped lower as an AW. Just get a letter from your department and get a Colt.

this. it was hard enough for me doing it this route and cost me extra money. If I could do it over again I would just buy a colt

I would make the same suggestion, just buy a Colt from an AW dealer. Thats what I did and it was a lot less heartache. Send in the card within 90 days to DOJ with all the weapons info with a check for I think $20, if I remember right.

Took almost four months before I heard back from DOJ, but I received a letter from them saying my AW was good to go.

Not only that, being a duty weapon, it's better to have the manufacturer's warranty. Plus I think it would look better if you had to use it in the line of duty, when DOJ takes your weapon and does their inspection. I would be feeling much better knowing mine was a stock Colt manufactured weapon.

I completely agree. Most departments will not allow a "build" from various parts and pieces anyway due to liability concerns.

I agree. I used two OLLs, had them BB equipped before I had them reg'd as AWs. I had to send them out of state to just switch the BB out with a normal mag release. The OLLs were custom engraved so it made it worth it, but I'd say get something on the "list" if you're going to get it registered. Plus a manufacture warranty is a big plus.

Just FYI ... per CA law if you leave your department, even for another dept., guess what... you have to LEAVE it with the department. If you retire or get out... yup you leave it with the department.

                            That's my understanding.

WRONG! It is registered to the person as an assault weapon and is personally owned, not department property. The peace officer exemption simply allows you to register it with the state after the deadline.
