    I'm surprised so few LEO brethren support this gentleman's reaction. What if they tackled him and got ahold of his weapon? What if you were constantly, day in and day out harassed by these little Mini SJW punks, jealous cause they walk to school thru a decent neighborhood from they're apartments? He dispersed those little dreamers in quick fashion and actually de-escalated the situation by firing a warning shot. Any of you actually know the neighborhood? I do. It's a dichotomy between decent middle class and close-by ghetto apartment projects.

      I hope if this goes to trial, i'm on the jury. This man was just in drawing his weapon. He was about to get attacked. Juvenile or not, the delinquents were clearly the aggressors and he had every right to draw on them. He was flanked and was cornered up against the side of the house he had to draw or get jumped and beaten.

        Im sure the kids did something wrong or threatened him.
        But the kids probably live and go to school near there.
        File a report, and walk into the school with local PD and have the kid arrested.

        Grabbing the kid with his buddies around is gonna turn bad for the cop, which it did. Especially with all the rioting and lawlessness going on, its the IN THING to do now.
        And DONT pull this crap in front of your castle, now his home and the entire neighborhood is going to be a big target for months.

        The chick that organized the protest RIOT, should be arrested for organizing a mob riot, and sued for damages.

          My folks taught us to be respectful of the property of others. Wether that be their yards/lawns or their car that parked way to close to yours in parking lot.

          In the video, IMO, the discharge was negligent. It's seems to me that when he drew the gun, then attempted to drag the teen over the hedge, he sympathetically (not sure if that's the right word) pulled the trigger. Grip and pull the kids belt, finger on the trigger...

          Additionally, after watching the video, he was not only detaining the punk, but semi blocked a punch and successfully stood his ground when the other kid tried to tackle/knock him down.

          Now if it had been one of us laymen, we'd be screwed just for drawing the gun.

            I hate cops as much as the next guy and am not afraid to call out the jack booted thugs in blue when I see fit and clearly this guy could have handled this better..... but..... at the point he drew and discharged, he had been assaulted and attacked and was about to be swarmed.

            Two takeaways I have from what I have gathered:

            1) The kids are insulant little ****s. The whole "I'm 13 you can't touch me" buttressed with the mother seeing no fault in her precious little child's actions leads me to believe the agitating principles in this incident will likely not live to see their 22nd birthday and if they do, it will be from behind bars.

            2) The homeowner is clearly frustrated whith the chronic and persistent vandalism of his home and neighborhood. It harkens back to Latasha Harlins though thankfully this man had the peace of mind not to shoot anyone. It's a death of 1,000 cuts, and even when you catch the little ****s in the act they just run away and local LE don't have the resources to do anything about it. How much frustration does it take for a man with POST certification to get himself into a situation where he has to discharge his firearm to disperse a crowd of adolescents who are about to beat the crap out of him? There's a good chance this officer will lose his job, though I hope he doesn't. I imagine he has learned valuable lessons and would be a valuable asset to LAPD moving forward.

            Just my 2 cents.

              Please remember you're only getting the media's side at this point! There is sooo much more that hasn't been released....according to LAPD guidelines he was with in his rights to fire a warning shot....also remember it worked, no one was injured!

                  Here's the thing. He should have just let it ****ing go. Are a lot of kids (my generation as well, I'm 25) disrespectful dickheads? Sure are. I can't stand most of them. Can barely stand my GF! lol -- But the thing is, as someone said above, as an LEO you are held to a higher standard. You KNOW what the right thing to do is, wanna know how many times a DAY as an LEO someone talks **** to your face and you just smile about it? I towed some girls vehicle because her registration was over 2 years expired, she told me she hoped I got shot and killed. I just smiled and told her to have a nice day.

                    My wife and I lived two blocks away for five years. Still own there. We decided once we were going to have kids that probably wasn't the place for us. Something about the bedrooms and "extra living spaces" we saw cropping up in garages, among other things. There was also no way two working parents who pull their weight were going to enroll our children at Ball Jr. High (no doubt where these "pillars" attended). There aren't as many apartments near where we bought.

                    You are right there is a dichotomy in those Anaheim neighborhoods that is (for lack of a better term) unique. The more time went on the more I felt bad for those who worked hard and had that pride of ownership. Can't imagine having to pull a gun to protect it. FFS!

                      Tom, actually the jury advisement for 422PC states that the victim need only be in "sustained fear" the threat may be carried out. It has nothing to do with the actual intent or ability of the defendant to carry out the threat. This is one of the extreme shortcomings of the statutes and one of the reasons it is used and abused so often. Many times 240 PC would suffice but since it's a misdo. many officers and DAs don't even consider it.

                      I've seen adult and juveniles admit to 422s that were contextually a lot weaker than what is described in the article. Sometimes this happens as part of a admission agreement and other times the kid actually wants the charge because of the street cred that comes with it. It's all very case-by-case

                      Also remember that 422 PC is a wobbler, so the DA may choose to reduce to misdemeanor either when filing the petition, or more likely, as part of an admission agreement. If adjudicated as a misdo, the minor would be eligible for informal probation with record seeing upon successful completion.

                        I just have one question for the LEO'S on here. Would PC 415(3) be a chargeable offense for both parties involved. If so for the officer, what is generally the punishment?

                          I will not comment on what lead up to the incident.

                          We have no idea how many times in the past this LEO may have just "Let it go" with these teens. Perhaps every adult in that neighborhood was being terrorized by these teens. With out all the facts we really can not say.

                          However from the video it was pretty obvious to me the teens knew he was a LEO. He had clearly detained one of them (justified or not). The other teens interfered in that process and clearly assaulted him. Too telling things stand out to me. First they tackled him into the bushes.Then the teen in red jumps over the bushes and is reaching into his back pocket for whet I believe is likely some form of weapon.

                          I feel the officer had valid reason to fear great bodily injury or death at that point. Pulling his weapon was justified. Firing a shot into the ground, while questionable did an adequate job of defusing the situation without loss of life.

                          Of course the liberals and media will twist this "For the children"

                                415 PC and it's subsections are generally used as an afterthought or as padding for an arrest for a greater charge. 415s are common and rarely result in arrest in and of themselves. If an officer chose to pursue a 415 without a more severe charge attached, it would most likely be a cite-and-release situation. Certainly in the case of Juvenile offenders, the minor would be cited and released to the parent/guardian.

                                In regards to repercussions for the LEO, any criminal conduct resulting in disposition other than dismissal is grounds for disciplinary action, up to and including termination for most LE organizations. However, there is no legal mandate for a conviction under 415 PC that would terminate his/her ability to be employed as an LEO in the state as would be the case with a felony conviction or certain violent misdemeanors.

                                In regards to the "'typical" punishment, there's not way of knowing that as agency policies and procedure and labor relations vary widely from agency to agency. In addition we have no way of knowing the officer's disciplinary history which would likely be crucial to making an informed opinion about new disciplinary action.
