    Selling P320?

    So I'm in trouble with the wife for spending too much on guns and something has to go. I have decided to sell the P320 I recently bought. I really like the gun but the only reason I bought it is because I thought my agency was going to go to it as our next issued gun, and unfortunately we did not. I don't "collect" guns so I decided it will be the one to go to ensure I keep my BB AR's since they are being banned next year.

    To my knowledge I can sell the off roaster pistol since it is used to anyone, however I have heard of some new law that bans certain LEO's from selling off roaster pistols.

    1) Is it legal for me to sell this used P320?
    2) Is there a time frame (like by the end of this year) I have to sell it by?

    1) Yes, nothing changed unless you are in one of those new classification's they added to be able to purchase off roster.
    2) Nope, unless your wife is really really pissed off and you need it gone like yesterday, and I've been there but it wasn't a gun that got me in hot water.

      I heard that ATF looks into sales made by LEO's to non LEO's if it is within the first year after purchase. They are looking at them as possible straw purchases. If you dont do it on the regular it shouldnt be a problem.

      Just something I was told. I dont have anything I can cite for the info.

        Why would ATF single out LEO's? Since in every other state anyone can purchase without Ca's stupid roster. ATF could care less about the off roster sales new or used.

          Really? That seems excessive if they look into everyone who sells just one gun within a year of buying it. I have only sold one other gun my whole life (rifle). I get it if someone sells a lot but just one gun sounds crazy. So I am stuck with this gun, and upset wife , for one year then?

              There is a lot more to the story than what is in the article you linked. There was arrangement's to purchase off roster guns, for individuals, these were not guns he purchased for his own use.

              OP your fine to sell it. 1 gun is not going to attract any attention what so ever.
              However buying 41 and selling 25 of them will.
              "McGowan purchased 41 handguns, selling 25 of them within a year after purchase, between 2008 and 2011"

                Wow. Selling 25 guns, even if he made 1k$ per sale, is not worth the money or jail time. Lost an entire career. Free government food and shelter for 18 months---pass.

                      Have one to train with I suppose. Some agencies specify that you can't shoot reloads through the gun, and well, let's just say that it'd be a super awkward conversation trying to explain a kaboom with a city gun when you were out plinking or competing and wanted to save a few bucks on ammo...

                      Or perhaps the guy wanted a similar platform for off duty carry since the P320s lego from subcompact to full-sized.

                      So yeah, not all LE are trying to make an extra couple hundred bucks on an off roster pistol while risking the ire of CalDOJ or any other alphabet agency. And to infer that would specious and OT.

                        I can't shoot any ammo except the same ammo my department uses ($) to shoot off duty. But I mainly wanted it to have a backup, subcompact model, and to have it at the house when off duty. I leave my department issued gun at work, I don't want to be bringing back and forth all the time. It's just easier that way and on top of that I forgot my duty weapon at home once :/ I want to carry/use the same model gun off duty (home defense, CCW, target, etc) that I carry on duty.

                          DNA pretty much nailed it on the head. The agency doesn't "give" cops guns. They let them "use" THEIR guns. It's not mine to do whatever I please with.

                            Its your money i guess. Im able to use my issued guns whenever i want. I asked because ive never met anyone who has bought a clone to the gun they are currently issued. Hasnt happened, because its odd...

                              I went 30 years without carrying a department issued weapon. I always bought my own.
