8th? In essence you can say yes. We the people have elected officials that appoint other officials that set standards of humane treatment. Can these standards go over board, of course. But they are there so we at least meet the standard that our community has chosen. California voters have made this state very liberal either through voting or lack if voting. I believe California has the strictest minimum standards in the US if not the world. This is the best lace to be locked up. Heck, if you get locked up, you can go to college for free. How many of our good kids get to go to college for free.
