Question about Vehicle Code 23103-reckless driving.

    Question about Vehicle Code 23103-reckless driving.

    CA, Vehicle Code 23100-23135

    CA VC Code 23103 states:

    23103. (a) A person who drives a vehicle upon a highway in willful or wanton disregard for the safety of persons or property is guilty
    of reckless driving
    .
    The above quote states "highway", but can "highway" also mean any paved residential roadway, or is there another code I should look for.

    The roadway, (a residential street within a mobile home park) is what the question relates to.

    Here is the actual definition from Section 100-680:

    "360. "Highway" is a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street."

            I believe their is a separate VC section for private property. Thats for the idiots tearing through the parking lot at Safeway.

                Can reckless driving be applied to idiots that stop on the 10-E to 15-N connector roads because they meant to take 15-S which is the next connector road?

                Can Reckless driving be applied to the idiots that zoom past me while I am doing 70 and pass me on either side and then cut in and out of traffic?

                Just curious as to where that fine line is before speeding becomes reckless... I would think that speeding and cutting in and out of lanes (without a signal) would be considered dangerous and reckless...

                  (No - For 23103 you need to prove the element of "willful or wanton disregard for safety". Just doing something stupid or aggravating isn't the same thing. However if it is stupid to the point of showing the "Wanton" element, then you could get there.)

                  (It depends. If they're they're doing it fast enough, and/or the lane cutting, is done in a manner that shows the "willful and wanton disregard for safety" then the offense is committed.)

                    If it is something egregious like doing donuts or burnouts on a busy roadway, then 23103 is all day long.

                    For general douchebag driving, I usually will do the 23103 if I witness 3 or more moving violations.

                      Most 23103's have speed, unsafe lane changes, and following too closely involved in their stupidness. That is plenty to cite for. If they are an ***, hook em' and bookem'.
