Technically, mres your issued are supposed to be taken out of your comrats. And if your a meal card holder, it's no different than going to the chow hall.

Now, jacking cases from supply or off the back of the 5 ton is a different story.

Point being, if your issued a case, and you don't eat said case, they are your meals to keep. They are YOUR rations not supplys.

You know you can face UCMJ action for getting a bad sunburn for damaging government property? Just like your ID card, MREs are government property. Stupid but it's the way it is.

In this particular situation it's not a big deal if you trade or sell them, but don't mention it to people after the deal is done. Just my personal opinion, take it with a grain of salt.

So, the ammo they issue you at the range isn't govt property anymore? It's given to you for a reason: to use, not to keep.

          From Article 108:

          (1) Military property. Military property is all property, real or personal, owned, held, or used by one of the armed forces of the United States. If is immaterial whether the property sold, disposed, destroyed, lost, or damaged had been issued to the accused, to someone else, or even issued at all. If it is proved by either direct or circumstantial evidence that items of individual issue were issued to the accused, it may be inferred, depending on all the evidence, that the damage, destruction, or loss proved was due to the neglect of the accused. Retail merchandise of service exchange stores is not military property under this article.

We would rat **** the hell out of them and even throw whole mre's away (mushrooms and beef) all the time.
Which would be covered under "fraud, waste and abuse" and Article 108 above, if it was serious enough for anybody to care.

I know plenty of people that would sell their mre's to people because they were left over.
I'm sure it happens a lot. Doesn't make it technically legal.

And command would even know because they were trying to get rid of the remaining cases or left over meals after a field op and were always glad someone took them.
I'm sure you're right. Seen it myself. Seen ammo shot off so it wouldn't have to be turned in, too. Doesn't make it the correct course of action.

In Iraq we gave the crap chow to the little kids out their so we could watch them fight over it.
Yep. None of which changes anything.

People DO it all the time no question and lots of other things they aren't supposed to do all the time.

Doesn't change that the letter of the reg says you eat it or turn it back in.

Advice from somebody who wore Army Green for a LONG time: If you do what "everybody else" is doing instead of what you're supposed to be doing you WILL eventually find yourself up Shiite Creek without a paddle... and "everybody else" won't be there with you.

They are YOUR rations not supplys.
You still can't sell or trade them any more than you can let somebody pay you to eat on your meal card in the DFAC.

The amount you're charged or deducted for the meal doesn't cover it's cost. You aren't being sold food, you're being issued food.
BAH and BAS aren't entitlements. They aren't your pay. They are money the Army gives you to support yourself because it's easier for the Army than handling it all themselves. You ever heard of any other job where you get paid more for being married? You get money from the Army to help support your dependents because that's what it takes to keep you in ranks and functioning as a Soldier. It's a stipend, not pay.

Even if they deducted the full cost of every meal from your BAS it STILL wouldn't be yours. They are just giving you food directly instead of paying you your stipend.

The only LEGAL way to get rid of them is to turn them in.

You know you can face UCMJ action for getting a bad sunburn for damaging government property?
That's actually a myth. You aren't property. When you negligently render yourself unfit for duty you can be prosecuted under Article 134-46--Self-injury without intent to avoid service. If you do it intentionally it's Article 115—Malingering.

My Grandpa told me him and a bunch of buddies got an Article 15 for getting sunburned after they fell asleep on a beach. Do you know if it was at one point? Regardless I'm sure they were making an example of the group. Thanks for the info, you're well informed.

We had an Article 92 on a troop b/c he was mixing concrete without gloves (after he was directed to wear them). Got serious lime burns and instead of going to medical, then went to the beach and got compounding sunburn on top of the lime burns and had to be medevac'd to Germany. No RIR, just some time on restriction and was the Safety-O's footman for a month.
