NYSRPA drops SCOTUS cert challenge of SAFE act

Searched and didn't see this anywhere.

Scalia's death is already effecting the fight. This will only get worse, and the reality is - If you won't even fight out of fear of what MAY happen, the antis have already won. Disagree all you want, but the citizens of NY are screwed. We will soon follow.

Members and Supporters: After three years of continued movement through the Judicial System the death of Justice Antonin Scalia accomplished a feat the anti-gunners were unable to do; it stopped our lawsuit. Below please find a statement Jay Porter a Constitutional Lawyer very much involved in NYSRPA V Cuomo and many other Constitutional issues prepared

I don't blame them. Nothing to gain at this point until the next justice is in place.
I would assume they could file another challenge later when the next justice is seated and be able to pass through the NY district and CA2 quickly since it's already caselaw in the circuit.

Big mistake IMO. Now or never. And our side just blinked

Besides, who's to say the Court won't lose another Justice by the time the case gets considered or heard? Assuming Scalia's seat remained unfilled we'd quite likely be looking a 4-3 victory...

That is the primary reason i left CA, at some point in states like NY one will be forced to comply, move or fight and i wasn't ready to fight...

What a predicament. Fall on the sword in the hope that a conservative justice gets appointed. Shameful its even come to this point.

Well, if you can't trust the judiciary, in addition to the executive and legislative branch, what can you do.

It's too late: Trump and Cruz have been in too vicious of a fight to "make nice" after Trump wins nomination.

FWIW my "dream team" would be Trump for Pres, Palin for VP, Cruz for AG with eventual transition to SCOTUS once opening comes, (now, since Scalia died, SCOTUS directly), and Carson for Surgeon General!

                      Oh well....
