So your friend was arrested and placed on a 5150 hold? A DVRO is a domestic violence restraining order, so was he arrested for domestic violence, felony or misdemeanor? You said he was acting like an idiot in regards to her, can you expand on that?

Suicide should not be against the law. If someone wants to self terminate, that’s their right. Better they do it early, than launch some mad mass killing to glory their own death.
If you find yourself in a fair fight, you're doing it all wrong.

I'm FFL Type 01 Dealer - And yes FFL Dealer can get rifle from SASD, it's really not that difficult.

However, if you were to come to me with this story ... I'd say no.

I have retrieved firearms from Sheriff Dept. before for individuals that lost their Right to own or possess firearms, but for RESALE and resale only. These were fine collections worth some bucks!

And a Mosin hardly seems worth the time.

Tell your friend to get some priority help with his issues, and based on your story loss of Firearms Rights doesn't sound like a priority issue in this case.

Some people just shouldn't have guns. Your friend sounds like he's got some maturing to.

$100 am month better spent on therapy sessions and a gym membership, than this guy getting guns back.

If your friend owns more guns, you should offer to store them for him before he gets stupid again.

When I read this story, about your friend who tried to kill himself because of a girl that doesn't like him, the first thought that came to mind was this guy:

Additionally, since this girl just recently also filed a restraining order against him, that tells me that his issues aren't really in the past. He's probably still trying to contact her. My advice, is put some distance between yourself and this guy, and stop helping him get his weapon returned, he sounds like he could melt down and really snap (worse than last time) the next time a girl rejects him, and you REALLY don't want to be associated with him when he does.

I realize I don't have all the facts, and that I don't know your friend, but he sounds like a prime candidate for a "mental health" gun prohibition, and frankly I am not sure it's a good idea to be around him anymore, although I do commend your support for him.

Settle down, folks. The new "ghost gun" regulations probably don't do what you think they do.

LOL.. The only reason your friend will not get his rifle back, is because he's unstable and a danger to himself and a danger to some others he comes in contact with.

Don't blame the Police because your friend is a wacko who wanted to shoot himself.

Hold your friend responsible for the consequences of his actions.

This guy is the poster boy of who should not have access to firearms.

Do you really want this guy to have firearms?

he is unfit to own firearms, I wouldnt take him shooting ever again, he's a risk, he might do the same thing at the public range.

Unless the gun is strapped down and the trigger is string activated or somesuch.
A sad little fact of WWII is that many a Japanese soldier did this very thing, pulling the trigger with his toe.

OP, your priorities are mixed up in my opinion. The priority I feel is not being concerned about getting your friend's Mosin back, it should be encouraging him to pursue getting the help he needs to work through whatever his issues are. My hunch is these issues will take time to work out. I don't think you are doing him much of a service by posting the details you have, regarding what transpired with your friend on a public forum of strangers.....it's his story to tell, if he wants to at some point.

Same thing Curt Cobain did with a shotgun.

Long story short he attempted to commit suicide with a mosin, police came took the rifle and he was sent to a psych ward. He was cleared a few days ago so he asked me for a ride to pick up the firearm from the station. He was told he needed to pay a fee to DOJ for the release and wait 1 to 6 months for a letter with a golden sticker, Once he gets the letter the firearm would be released. Only catch is every 30 days the firearm remains in police custody he will need to pay a 100 dollar storage fee (6 months = 600). I called a FFL to see if we could get it transferred but I was told it would be to much red tape and the cost would exceed the price of the mosin. A few days she also placed a restraining order which bars him from owning the gun. When I told him about apps he looked confused and did not believe me when I told him the DOJ would come for his mosin if he got a hold of it.

This is the kind of crap those communist have established in California. If you get arrested the DOJ will make it way to costly to recover your property on purpose. As for the mosin it was a plain 91/30 that now belongs to Santa Ana PD

although this did not happen to me the thought of loosing a collection would be enough to make anyone stomach churn.
I had an HS Precision rifle and Colt New Service on consignment at a LGS a few years back when CA DOJ closed down the shop for some reason unknown to me. CA DOJ contacted me and required me to complete a LEGR. Since there were many other folk's guns involved they set out a "come and get them" notice that was timed for after we had received the LEGR "Gold Stamp".

As of a few days before the pick up I hadn't received the stamped notice. I believe the time from completing the LEGR app to pick up was just under 30 days. The ATF Agent I was trading e-mails with told me "no problem, just come get your guns". When I arrived they pointed me to a room, I grabbed my guns and after a brief check out left with them. There was no "storage fee".

Whether a person ought to have guns or not I'll leave for others to comment on. But the process should be simple - do the LEGR, get the approved release back and pick up the guns. A storage fee being charged seems to me a method PD is using to discourage a person from reclaiming their property. If they don't do it for a bike or a TV they ought not do it for a gun.
