10 Year Ban Rights restored

    10 Year Ban Rights restored

    I just completed 10 years without a conviction after having my gun rights removed for a misdemeanor 242 Simple Battery. Triggering a 10 year ban under California Law.

    Long story short, I was protecting my pregnant wife, plead for a 8 day sentence so I could be out in time for my first born's birth.

    Now that it has been 10 years can I just go buy a gun? Do I have to still file special paperwork?

    Any advice would be appreciated.

    If you want to be 100% sure that you can now legally acquire, own, and possess firearms/ammunition; then submit a completed Personal Firearms Eligibility Check Application (BOF 116) to CA DOJ BOF.

    CA DOJ BOF will mail you back a response.

      I saw this, it just kills me to wait another 60 days. Seems like I have little choice to be sure. Feel like I'm wasting time while Comie'fornia laws get more restrictive.

        You're not required to submit the PFEC, it will just help you avoid the drama of putting $1k down on a gun and finding out something with the courts wasn't done correctly or on time, and then potentially you being out a 25% restocking fee or other BS while you clear it up.

          Thank you for the advice. I am getting a call back from a lawyer tomorrow. I will post any info I have here. I have scoured the internet and haven't seen any one talking about purchasing a firearm after the 10 year ban.

                          So to answer your question, OP, the answer is simple. Whether or not you are still under a 10 year ban you can apparently still acquire guns just fine, so I don't see the purpose of your question
                          Settle down, folks. The new "ghost gun" regulations probably don't do what you think they do.
