This is why Los Angeles is trying to make Homeowners responsible for the maintenance of City sidewalks. They can't afford to repair them, and they certainly can't afford the liability... I know... why don't we legislate the the responsibility onto the already overburdened Homeowner... they're the ones who USE sidewalks anyway.I do have a multimillion dollar general liability policy, have to read it again to see if it excludes firearm related liability. Purchased it when the city was slow to repair the sidewalk in front of our house, in anticipation of some fumble footed progressive lawyer tripping over the raised crack...Comment

This could actually be a financial windfall for 2A organizations...at least until the law is overturned (think about the AARP example). Besides the obvious Constitutional issue, a workable insurance program is a minefield waiting to blow up their careers. I seriously doubt that they can draft a workable bill this year. Even if they start with a failed insurance bill from another state, navigating California insurance regulations is not as simple just making insurance a requirement. From their press release it is clear that they do not understand how insurance companies work (much less the average gun owner which I think they perceive as a common criminal), but only that, for them, it feels good to pursue an insurance requirement.Thermidorian Reaction . . Hold on! I understand that the NRA already offers some kind of liability insurance. Guess I should read the spam more carefully. Mrs. Wrangler, who used to be a claims rep for a major Factory Mutual insurance company is looking it up now. Seems there is Excess Personal Liability Insurance for hunting and self defense for $254 per year ($250,000 limit), you can apply online. Mrs Wrangler won't stop studying until she knows more about it than the NRA!Oh? Didn't read the text of the bill, but does it require insurance carriers to underwrite a firearms specific liability policy? If not, then I doubt the carriers will comply, leaving the gun owner out in the cold. Then again, given the safety record of firearms compared to other risk exposures, maybe they would be falling all over each other for such a market. Just think, if this bill passes it could become a source of income for the NRA and any other gun lobbing group ready to offer such policies. I bet the NRA would have a policy ready to go before the ink dries, with monthly mail and email spam to tell you about it. Unintended consequences - gotta love Sacramento.

Without pants I would turn people to stone, hence the need for liability insurance. Fortunately, since then the city replaced the sidewalk and enlarged my driveway as part of the cost-sharing program, but I kept the policy anyway.

It depends on the city. Here we have the 50/50 city/homeowner cost sharing. Not a bad deal, as I had to chip in $850 additional to have my driveway ramp doubled for a total of $1385 for the new sidewalk. I went through the city's concrete contractor with a private bid for a replacement expanded driveway to be done at the same time for an additional $6000. We have no parking strip planter, our property line is the curb, with five foot a city utility easement, so liability is shared. $254 per year, no way would I pay that. That is some seriously flawed actuarial analysis right there. From the criminology I have seen on CCW use from John Lott and others, the ownership of firearms decreases crime. Law-abiding gun owners have a near zero chance of being liable for firearm misuse. If there are five million gun owners in California participate, paying just $10 per year (for those with no criminal record) would lead to fifty million per year in revenue with I doubt more than a few million per year in costs from lawsuits, at most.Seems there is Excess Personal Liability Insurance for hunting and self defense for $254 per year ($250,000 limit), you can apply online. If the NRA started an insurance arm, this would be a windfall of gigantic proportions. If liability insurance of $10 per year were offered with the yearly membership, NRA membership would more than double, from 4 million+ to 9 million+. (I still think this bill would make a terrible law.)
Sure poll taxes have been declared unconstitutional since a 1964 court decision on the 14th Amendment, but keep in mind that amendment was around for nearly a hundred years before poll taxes were overturned. It might take a year for a case to get to SCOTUS, and then the state might practically ignore most of the decision like Heller and McDonald. Keep in mind there are currently no operating FFLs in DC last time I checked, and in Chicago you can't take an assembled, uncased firearm from your living room into your attached garage. And of course recently we have the Obamacare decision, where the mere fact that you are alive and breathing makes it legal for the government to require you to pay a tax.Comment
