    DROS delay odd situation

    Hello I need some advice on a delay I just received between two gun purchases.

    The first was a .22 I purchased on 7/15 picked up 7/26. No problem.

    Second one sks from same dealer purchased on 7/26 (while picking up my 22) he was honest and had to go out of town so I was to arrange for pick up on or around 8/16. Ok with me I feel I got a good deal and the dudes cool.During that wait around 8/3 saw a special on a .44mag and had to buy it. Pick up 8/13 No problem(gun 3).

    Now for the funny business. 8/16 comes around contact the dealer he says there is a delay... OK. Wait a few days call him back and no good info. After a brief search I find the doj number to call. Didn't take long to get a hold of someone and gave my dl number then placed on a brief hold. I was expecting it had something to do with my2 dui's( only misdemeanors and already taken care of) but the lady came back asking about an incident with the boarder patrol. It took lots of binge drinking to forget the bs that took place that night but basically my friend had some marijuana in the car we were pulled over by the bp i took it because it was my vehicle and i had a medical card. I don't know what to call it but a third friend drove my vehicle home and we went to bp jail in bfe. I did the best i could with the circumstances all but one guy were not that bad didn't sit in cuffs and we were only detained? For about 4 hours. One of the agents who explained the situation said they would send the"evidence" to a judge and he would throw it out. No problem... Right?

    So this is the first I'm hearing back from that and it has been over a year. Lady on the phone says call back in 10 days to see what they decide. Ok... I let her know of my most recent purchase(my first handgun) and how it was ironic I had no trouble there. She mumbles something about how she hoped she didn't approve it pauses for a minute then says I'm going to have to look into this. I say ok and she quickly says bye with no further instruction and hangs up the phone.

    Am I safe from any action on their part if a mistake was made or should I be digging a hole in my backyard right now?

      I'm just curious here you have a medical marijuana card that the fed's don't recognize, you were detained by the border patrol with we can assume marijuana in the car crossing the border, but were not charged. DOJ is holding up a dros for a detention, or was there an arrest made? I've never seen a detention entered into a data base, maybe the feds have a different system, but something don't smell right here.
      Also how did you answer question 11(e) on the 4473, keep in mind the feds don't recognize medical marijuana usage, as far as I know.

        Um just a thought, but multiple gun purchases and an arrest crossing the Mexican border for drugs just might throw up some red flags with recent events in Mexico.....

          I apologize I'm using my phone.. No i did not cross any border, state or international and I'm not trying to debate federal and state laws. I just think it is strange that i was able to purchase a handgun after this transaction was "flagged" also the manor in which the doj lady ended the phone call.

              Of course your name is in the system now for being detained. They are very serious at the border now. Im sure it should be no problem but some smarty pants at the DOJ decided to hold your purchase based on a review because they noticed it in the system and decided to look further while all the DOJ reps before knew that it was no problem. It should not be a problem since you were not arrested...or were you? If you werent arrested you should be fine its probably just some smarty DOJ who decided to mess with you because he noticed your little "incident". Keep calling back and do not give them more info then they need. Tell them you were detained and thats it!

                I think there is more to the story than you are recalling. Border Patrol stopped you why? I still don't quite understand why they held you for 4 hours for what is basically no more than a ticket. Evidence doesn't go to a judge for a decision to throw it out it goes to a da, you may want to dig a bit deeper into what happened that day. Not saying your lying but it really doesn't add up, don't know if your not remembering or someone fed you a line of bs to start with

                    I always thought an arrest didn't count. Only convictions.

                    This is scary that the CDOJ would reach back that far on something that doesn't even prohibit gun ownership...

                          I can't tell if all of these DOJ "delayed DROS" events are de facto gun control or if they are trying to justify their own budget with "further investigations".

                            Line e on your 4473 or DROS asks if you are a habitual user. Your medical marijuana card answers that question YES. But you probably answered no. Which means in a nice way you were untruthful in answering the questions.

                              Thank you all for the feedback (and editing). I cannot think of one legitimate reason for being pulled over that night. I was about a mile or two from the checkpoint and had no intention of going through it. We left a recreational area in the mountains only to be followed by the border patrol and stopped on the freeway. They did not have a reason to pull me over or search my vehicle but I was driving with a restricted license so i decided to cooperate.

                              I was never allowed to speak with an attorney but maybe that's why the one agent assured me nothing would happen (or to get me to stop asking). Compared to staying over night at the county inn it was not that bad and have heard nothing of the instance until now.

                              I have purchased 4 guns since then and it is the third purchase that i am having problems with
