    Read the Jason Davis analysis and you will see that a "fixed" mag rifle is different form a BB'd "non-detachable" mag rifle.

    I neglected to realize there is a difference. And FGG's interpretation is interesting in that as long as SB 249 is not passed and given the current legal terms, a BB'd rifle can use large cap mags. But this is only FGG's interpretation. I doubt many others would share his view or risk it.

        I'm sure this has been covered, BUT when you contact Yee and the other legislators, provide them concise and other activities they should be spending their time at, such as:

        1) Improving the quality and safety of public education for those who can't afford expensive private schools.
        2) Focus on creating an environment for job growth for Californians in California!
        3) [Insert your 'improve quality of life' cause here...]

        This way we don't all look like we only care about 'guns'. We should be appalled that they are wasting their time on issues that only affect law abiding citizens and do nothing to improve the quality of the life for the entire state.

        I know we all genuinely care about the quality of life in California for Californians and those who visit here.

        Let's make sure the media and politicians hear that!

          But fixed magazine rifle is not defined anywhere. Only detachable magazine . . .

              For those arguing about the semantics of the bill, let me suggest something.. More gun control -- no matter how well intentioned -- is never a good thing. None of these laws make anyone safer. None of the laws make anything better. The only people who benefit are the politicians who get a dog and pony show to show their constituents how much they did while in office.

              This country needs to get rid of full-time legislators and go back to the original part-time legislator ideal that the founding fathers wanted.. Idle hands and all that....

                Just to reiterate:

                1. I do think that we should oppose this bill. No bill of this kind is better than any bill of this kind.

                2. I do disagree with the Davis analysis for the reasons I gave. I am not asking anyone to "join my analysis." But there appears to me to be a lot of histrionics going on about what SB249 would do. I do question the wisdom of making the memo public. As IPSICK pointed out, someone down the line might cite it or at least adopt its logic against us.

                3. If someone can explain to me how a "public nuisance" would constitute a violation of a criminal statute I am always happy to learn new things. Public nuisances are typically never the subject of police interest and generally require civil litigation from a plaintiff with standing.

                I decline to respond to any of the ad hominum remarks in this thread. If you don't like my analysis, that is OK with me. Quite right that my law practice does not focus on gun rights. In fact I do not practice in that area at all. I do, however, read statutes and cases for a living. I thought that it might help calm some people down who thought that this bill will take away our right to own our semi-auto rifles. I do not think that it will. I believe and hope that I am correct. I love shooting .223 semi-auto rifles and I own 3 of them.
                I agree with your statement Roger, but what I am fighting for here is that this bill does not turn into something else so why not just nip it in the bud to begin with? Gene said to hold fire on this bill for now that it may not be as bad as we think, but there is also the fact that more gun control = less gun freedom like Drdavid said.
                Firearms successfully returned by the CA Department of Justice. Probation expires October 2014.

                  I'm fairly new here but I read these threads every day. I've personally gathered that certain individuals here are on the front lines of the 2A battles. I'm not very skilled in interpreting the legal aspects of pending legislation, but a call to action such as that by the Op gets my attention and support. Thank you for your efforts Mr Combs.

                        Signed, liked, shared. Definitely need to stop this one before it starts, potentially lots of unintended (or secretly intended?) consequences. Couple of thoughts;

                        If the Davis memo is correct, and a BB does not in fact create a "fixed magazine rifle", then FGG has a really interesting point since the AW law refers a to any rifle with a "fixed magazine capable of holding more than ten rounds" (paraphrased). If a BB does not create a fixed magazine, then there is no reason you couldn't load up a beta mag in your BB'd AR.

                        Also, if the analysis is correct, and a BB does not create a fixed magazine rifle, then it is possible that this bill will do even less than Yee intended. The question is this - what combination of parts will convert a truly "fixed magazine" rifle into an assault weapon? It is, by definition, logically impossible. I can think of only one example of a simple part or combination of parts that can be "affixed" to a "fixed magazine" rifle, that would turn it into an assault weapon.
