    Legal to buy gun for son?

    Is it legal to buy a handgun soley for the purpose of gifting it to a son thru the DOJ Intrafamily form?

    Yes. He should acquire a Handgun Safety Certificate before taking possession, any FFL can give the test. After you give the gun to him he must fill out the Operation of Law form to complete the transfer. The form can be obtained at http://www.ag.ca.gov/firearms.

    He must also be 18 years old before he can transfer the gun into his name.

      And don't tell the FFL that you are buying the gun as a gift for somebody else. FFLs are under a lot of pressure to spot and deny "straw purchase" sales. Many of them are not able to understand the difference between a legal gift purchase and a straw sale.

        i bought my son a "gift" in august,the week he was born.

          Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

              I don't see why not.

              Keep in mind though that it could very easily be looked upon as a straw purchase if the son asked you for it specifically because you are a LEO and exempt from the roster.

              But if you are just out and decide "Hey, I'm gonna do something nice for my kid.... Here's a nice gun. Oh, it's not on the roster? That's ok, here are my LEO credentials", then it should be fine.

                This is why I like frequenting my local Turners. They know my wife and I, they have sold guns to both of us, so last month when she went in to buy me a shotgun she straight up told them that it was an anniversary gift for her husband. They had no problem with it and called me lucky when I escorted her in after the 10 days to pick it up.
