Rham Emanuel moving to moot Ezell v. Chicago

Not good news if this ordinance passes before the Ezell decision issues:

It sounds from the article the same kind of zoning they do for adult businesses. When they add a safety plan the City can put all sorts of conditions on the range operator which will make it more costly.

I'd rather the court made the decision. Then the next fool that tries to pass a range ban will have precedent to consider.

Smart, very smart. This guy is really dangerous. Chicago's city council is made up of a bunch of truly dim bulbs, but Rahm is just the kind of guy who understands how to control fools.

                    Merde!

We usually do better against true believers. Emanual is a smart pragmatic power lusting politician. He sees the handwriting on the wall and wants to keep as much power as he can in the hands of the City of Chicago's government.

Chicago's lawyers will probably file a notice with the court to alert them to possibility that the case may be mooted by the ordinance. Unless the judges are determined to issue an opinion under a theory that "the wrong" that was infringing the "the right" is capable/likely of repetition, the notice will be enough to delay the decision - at least until everyone gets to take a look at the ordinance.

This is NOT a good turn of events.

That was my first reaction to the news. Since they have to obtain approval from Chicago PD and the Police Superintendent is spending his time preaching how guns are tools of racist oppression, I don't think it's such a giant stretch of the imagination for the court to conclude there will be further shenanigans.

I'm not holding my breath, but I'm hoping they issue a decision.

This all assumes that the Chicago folks aren't too stupid and obstinate to enact it AND our side isn't smart enough to counter with pointing out that it can and will be implemented in an arbitrary and deliberately inhibiting manner.

He is doing it because it will remove the plantiffs standing. This would end the lawsuit.

They could get that standing back in an instant if they or anyone run into troubles with it being a 90-99% ban merely replacing a 100% ban.
