Yes, but if uses retreat strategically with much less "true believerism" and is very pragmatic we will not be able to win decisions. He'll just keep strategically mooting things. In the end that strategy will leave us with more restrictions than we would if we were fighting a true believer who will not give up.

Here, here. Sadly, I think that winning has a darwinian effect of taking more and more true believers out of the fight on the other side.

Docket Update - 11-AUG-11
Per a Minute Entry (#116) posted this morning:
1) Hearing scheduled for Monday 15-AUG-11 is cancelled
2) Ezell's response to Motion to Dismiss due Monday 29-AUG-11
3) Chicago's reply to Ezell's response due Friday 09-SEP-11
4) Judge's ruling to follow
5) Next status hearing set for Tuesday 25-OCT-11
It appears the Circuit Court's directive regarding the issuance of a Preliminary Injunction is not going to be directly addressed anytime soon.Comment

Now that's what I call freedom to exercise a right.A permit costs $100 and must be renewed every three years. In addition, it costs $15 to register each new gun. Permit-holders also must submit an annual registration report.

At least the motion was not granted outright. I have a feeling Gura can frame up his response in a way that will make it nearly impossible for the court to dismiss. The court doesn't seem to high on Chicago's POV, and Chicago has proven they won't do the right thing without being dragged kicking and screaming.Per a Minute Entry (#116) posted this morning:

At this point the court must surely realize that unless they step in with a decision/opinion in writing, that Chicago will just continue to play the same games. I am optimistic. The writings of the 7th circuit so far have demonstrated a lack of tolerance for corrupt politicians looking to deny rights.
Now we just need to wait two more weeks and we'll have shall issue in California
