I was initially curious because the .22 version has 20+1 capacity. Made me wonder. Then I saw that the 30-30 only had 6+1 anyway.

It's not semi-automatic. The AWB isn't applicable even if it could hold eleven or more cartridges.

Tubular magazines are also specifically exempted.

I was wondering about this too recently. I saw that theres a Rossi M92 in .357 that holds 12 + 1 in the chamber. Wasn't sure if that was legal or not so I guess it is. Now I've got to find someplace that sells the Marlin 1894 or Rossi M92 and see which one I like better.

Tube magazines feeding lever actions are exempted from the high-cap magazine ban.

I've bought four Marlins here in CA over the past five years, the 336 is a fine and completely CA-legal gun.

There's a specific exemption - PC 12020(c)(25) - that says tube mags in lever action guns and 22 cal tube magazines are not 'large capacity ammunition feeding devices'.

It's a joke. The other posters above are correct, there is SPECIFIC language in the law addressing those arms with tubular magazines and lever actions.
