      INTERFAMILIAL HANDGUN TRANSFER QUESTIONS HELP!

      Its me again! I have one more question. I am still confused.
      I want a Glock 22, but I am only 19. My mom is going to buy the handgun for me, within a FFL dealer. We are going to perform a intrafamilial handgun transfer.

      I do know the requirements for the intrafamilial handgun transfer is:
      I have to be 18 (I am 19)
      I have to have a Handgun Safety Certificate.
      And pass the DOJ form.

      My question is this...How does my mom transfer it to me? It says I cant transfer it within a FFL dealer. So how do I do this thing? Can I get the handgun within the FFL dealer?

      Somebody help! thanks.

        No, your mom will buy the handgun at the dealer. After that, you will have to file an Op Law form and mail it in to the doj. The transfer between you and your mother does not require a dealer, which is why it is legal.

          Yes...the only thing you have to do is get a Handgun Safety Certificate and wait until your Mother comes home with the firearm. At that point you can fill out the Operation of Law / Intrafamilial Handgun Transfer form, mail it and a check for $19 to DOJ and you are done.

              Do I have to wait for the DOJ to send me a form back saying that the gun is transferred? Or can I just have the handgun after I send it in? And if I have to wait how long does it normally take? And on the form, it says owner information, do I put my name or my moms name?

                That I do not know... I'll be buying my first handgun this way also, so any relevant information is appreciated.

                  It averages like 3 months.

                  The point of the form is notifying the DOJ that the transfer has occurred so I would imagine the firearm yours already. You are just telling them you have it now.

                  Just be careful with law enforcement. Some have probably never heard of this. If you wanna be safe, make a copy of the form you're sending and keep it with your glock.

                    Right. Once you fill out the form and drop it in the mail with your check, you're done.

                          Heres what Im doing. My mom and I, are going to a local FFL dealer, and she is going to buy a Glock 22 for me.

                          Do I have the steps correctly?
                          Step 1: My mom buys the Glock 22. She fills out the DOJ form and takes the hand gun safety test.

                          Step 2: I take the handgun safety test.

                          Step 3: We wait the 10 days, and then pick up the handgun.

                          Step 4: I fill out the intrafamilial handgun transfer, and send a check for $19 to the DOJ.

                          My question is what is the point of a "gift"?

                          PS: I am 19 years old, and my mom and I both live in CA.

                                Because you are under 21 you are unable to purchase a handgun via a retailer or private party. The handgun being a "gift" from your parent or grandparent is the only legal way for you to take ownership of that handgun. See DOJ FAQ #5
                                Can I give a firearm to my adult child? Can he/she give it back to me later?

                                Yes, as long as the adult child receiving the firearm is not in a prohibited category and the firearm is a legal firearm to possess, the transfer of a firearm between a parent and child or a grandparent and grandchild is exempt from the dealer transfer requirement. However, if the firearm is a handgun, you must submit a Report of Operation of Law or Intra-Familial Handgun Transaction and $19 fee to the DOJ within 30 days. Assault weapons may not be transferred in this fashion. See Penal Code section 12285, subdivision (b).
