Perhaps so.... but that kind of logic makes about as much sense as leaving my bullet button wrench installed on the gun because I am going to be removing my magazine when I get home.

The moral of the story.... NEVER transport a firearm in illegal "condition". Perhaps that... and learn how to tow a trailer... but plenty of us here have harped on that one already!

1.) Plumcrazy is a new brand and I believe most any CA FFL would have instructed the buyer of the lower to 'keep it legal'.

2.) If the resultant rilfe were split apart, AW charges are not valid.

3.) Hell, the CHP could have charged an AW violation for a BB'd or MMG'd rifle.

We'll try to find out more.
Meh... I've purchased lowers before and no one said I had to get a BB or build it featureless... It was kind of like, Here's the lower, here's the LPK/Stock... Have fun.

Though, I knew I had to keep it legal (I.E., Rimfire, BB, or Featureless)...

Still, as all have said impossible to be able to tell at this point.

Interesting that the same person to make the referral also said that you can't currently get those rifles legally.

Obviously heard about CGF, but not a user here on CGN.

There isn't enough information to determine pretty much anything there. It may or may not have been an "assault weapon". He may or may not have been wrongfully charged. All I can say is, he was so close to freedom, yet so far away. That's gotta suck.

              Discretion?

Even if, BIG IF, the man was in possession of an unregistered "assault weapon" the DA should demonstrate reasonable discretion and not prosecute. The man was leaving California! Isn't that exactly the supposed purpose of the AW ban? To drive them out of state?

It would be crazy to prosecute under these circumstances. Prosecute and incarcerate while the city and State are going broke? Madness!

                1. He knew damned well it was illegal; or

                2. It's perfectly fine and the LEOs don't realize it (and we have certainly heard that one before).
Kind of have to agree with this. Too bad there isn't more info available.
