Holy crap...so 1934 failed? What was all that stuff Gene was talking about in regards to this opening up lawsuits, etc? I'm glad it failed. Does this mean you guys that are "against" UOC are still not going to be content till we get CCW?

In conjunction with that, if one takes a look at Gene's thread on the definition of concealed carry it starts to look like the distinction between open carry and concealed carry can be pretty arbitrary - or at least has been.

AB1934 might have also been helpful in showing that the distinction was quite arbitrary as they would have gone from a 12025 definition explicitly defining a holstered weapon as being open/overt to a holstered weapon as being concealed. It has got to be interesting when precisely the same carry is one moment open and when a piece of paper is signed by the governor it is concealed. No material fact would have changed except that the governor and the majority of the legislature would have decided that they liked a different definition for a holstered weapon. It gets even more interesting if you remember that a few years ago they flipped a holstered weapon from concealed to open - and AB1934 would have flipped it back from open to concealed. So there would have been at least two arbitrary changes of the definition of a holstered pistol. I guess I don't really know - but I'd think that kind of flipping would help a court decide that the definition of concealed vs open is very arbitrary and that when a fundamental right to bear arms as well as a fundamental right to free expression are put up against the state's right to limit the method of carry - the courts will require both CCW and LOC.

But I do completely agree that this is not the time to present this to a court. Much needs to be done before I think we'll have the proper odds of prevailing. Until then, get your CCW, carry concealed, and await the day that SAF, NRA, and CGF can further secure our rights.

All I can say is it was tense in the Capitol but in the end we defeated all gun bills this year. There were 7 gun lobbyists present on these 3 bills. I may explain more later.

Thayne i watched it live on 2 screens, one for the assembly floor and one for the senate floor, there was very little stalling going on. Lots of deals being made in the back of the rooms but that was about it. you can post as many newspaper reports as you want but those reporters dont even watch what was happening, they get second and third hand reports.
