How would it look if you shot an "un armed man after you had control of the situation with a gun" chances are that's what his families defense attorney would say. Then his buddy can just lie and say "he just shot him and said 'break into MY house?' i think not!'"
Depending on what he shot into, i'd rather put a round into my big sofa, or my ceiling or fireplace or something.

NOW! if the warning shot fails and he keeps coming at me, i'd shoot him.
Maybe the idea would be "i tried to do everything reasonable in my power to prevent the individual from taking my gun"? i dunno. Just a thought.

I'd suspect the homeowner just missed with the first shot and when the BGs got compliant he didn't continue.

So why hasn't anyone asked how the victim came to be holding a handgun in the first place? CCW, lawful or not?

It's fairly easy to get a CCW in Fresno. And even if he was carrying illegally, no jury here would convict, nor do I think the DA's office would want to even make the attempt.

I only really worry about the warning shot as to its legal repercussions. Most every city code I've seen has laws against the discharge of a firearm within city limits unless it is in defense of your life, and I wonder if it could be argued that a warning shot is not proper defense of ones life. It's not that I believe that, it's that I don't want to be facing that down in court with the prosecutor having yet another scruple to stack or wage against my case.

Like I said, no jury here would convict, nor would the DA want to try. Political suicide in a conservative area like this.

Good job. But when you get home and someone is in your house, you don't go in, you call the cops from outside. They could have had a lookout ready and shot him walking through the door.

Well they've killed 9 people this year, and let's just say they ain't ever helped me none. I am not fond of Fresno PD at all myself. Sorry if any Fresno PD are reading this. You might be good at what you do and might be the shining example to which all Fresno law enforcement should be held. Just haven't met you yet.

I have my reservations about FPD and chief Dier, who is a politician, not a cop. But all my actual interactions with them have been very reasonable.

Check out the positions expressed by the Fresno DA. The last DA we had would not prosecute householders for shooting intruders fleeing over the back fence, and this one has stated that she sees no reason to change that policy. I would not push my luck, but any reasonable person has a lot of leeway here.
