Because when someone like Brown takes that oath, they believe that taking the office gives them the right to define what your Constitutional rights are to begin with.

This is undoubtedly true of Kevin DeLeon and countless others in Sacramento. Not to mention judges, law enforcement personnel, and the list is endless.

It seems many of today's politicians believe the oath of office is:

I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States, except for the parts with which I disagree, against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.

The people that voted those politicians into office would probably be tickled pink if the oath were worded that way.

Nah, that's not the oath they take...

He got a 3rd and 4 the term.
                He's not running again.

It's the same with the President, there is no consequences for his actions or inaction.

If the legislature were to flip control or a Reagan like person was running maybe.

Haven't you heard? Feelings trump the Constitution.
